Pfeil, Schweiring, R.S CHARGED with Fore¢zry.—In the Criminal Court, yesterday, before Judge Fisher, Jonn Moulton was placed on trial for forgery. The evidence showed that the accused had a claim against the Government for a pension of eight dollars per month, he baying served in the army, that he presented to the Pension Office affidavits of two parties sworn betore Thos. J. Myers, which affidavits were refused at the Pension Office on account of not containing the facts im the case. On his application the affidavits were returned to him, and by him the same notary with the names erased, and a request that Mr. Myers should insert other names, which Mr. M. refused. The accused then inserted two fictitious names, and ied the same at the Pension Office as a part of the foundation of his discovered by the Examiner, and the accused arrested and Smithers, for defense, contended that accused could not be convicted of forgery in tabricating tesUmeony im support of an honest claim. The District Attorney asked the following instruc- tom, wRich was refused, and also a request thatthe question be certified to the court in m. The forgery was indicted for if the jury believe frem the evidence that the prisoner bad an honest claim sgainst the Government for & pension, and that to obtain said pension, be erased the name of the real agiants from the affidavit mailed and offered in evidence without the knowledge of the notary public before whom the affiant was Sworn. and inserted two fictitious names, to- wit: William W. Billings and Joseph Ulan- cy, and presented said affidavit after it had been altered as aforesaid, to the Pension Office &s the foundation of bis said claim, they should find him guilty of forgery.
