The counsel for Kimball cinimed thatas a general rule ali things cn the premises were liable to seizure, Whether they are the effects of the tenant or of a stranger. The exceptions are founded upon principies of public policy To take this case out of the general rale, it must be shown that the business of the tenaut | Wassuch as naturally todraw a piano to the | house. The landlady could not, in this case, have given eredit to a visible stock on the premises, which is supposed to be the foundation of the right of the Jandiord to dis- traim every thing he finds there. To sustain the right of distress, in a case like the present, “would enable the landiord,” in the languaze of the books, “to practice a fraud and contri- | Vance, to subject the goods of innocent people to distress.” The tenant here isin possession of a large amount of valuable farniture, with the consent of, and under an agreement with the ae which said agreement is un- known to the public.
