As it Is a subject of much discussion when the writ will be returnable, it may be well here to quote the law of Maryland on the subject of habeas corpus. “Section 4, of act 43, says that the officer having the party serving out the writ shall within three days after such service make return of the writ and cause the person detained to be brought before the court or judge, according to the demand of the writ.” ir this discretionary power of the warden to return the wri? within three days should be availed of, it is supposed the parties may not get a bearing before Tuesday or Wednesday morn- ing. Itis not known what course the warden of the jail will take. If the parties should be brought before Judge Haitol to-day, it is pre- sumed the whole question and the numerous points of law involved will be discussed by the counsel on either side.
