These steps proved to have been necersary, 428 no one seemed disposed to interfere with the arrangements there for the time in operation. Gov. Swann, early jterday morning, re- turned to Annapolis from Washington, and subsequently, accompanied by Gen. J. Sum- merfield Berry, Adjutant General of the State, Jobn M. Carter, Esq., Secretary of State, and other gentlemen, left Annapolis ina cial train, which connected with an express train from Washington at the Annapolis Junction, and reached the city at 124 o'clock. Soon af- ter it transpired that others than the gentle- men named yesterday would be appointed commissioners of police. George R. Berry, Esq., ee, appointed, positively declined on account of business engagemenis, and Gen Jebn W. Horn, the other appointee, consid- ered himself disqualified in consequence of having lost his residence by a temporary re- moval from the State, and the police law re- quiring a residence of one year previous to ap- pointment. ln the meantime, however, com- missions had been issued to Wm. T. Valiant and James Young, Esqs., as commissioners of police, who ap before Judge Martin, of the Superior Court, for the purpose of taking the oath of office, Judge Martin said:—“In allowing these ap- plicants to take the oaths required by the ist section of the article of 1862, chapter 131, I de- sire to be understood as expressing no opinion on the question as te the jurisdiction of the Governor of Maryland to remove the Police commissioners, who were in the office under the appointment of the Legisiature, for official misconduct, or as to the validity of the title of these applicants to the office to which they claim to be entitled under the appointment of the Executive. In directing to be administered to these applicants the oath required to be taken by them by the act of Assembly, 1562, ch. 131, the court performs ouly a ministerial duty, which wag, Hache er by the clerk.” Messrs. Young and Valiant thea came for- ward and took the necessary oaths, which had been prepared by Messrs. Latrobe and Schiey, and at once left the court room. Shortly after three o'clock, Messrs. Valiant snd Young, accompanied by Mr. Carter, Secre- tary of State, drove to the office of the Police Board, and were met at the gate leading to the office by Deputy Marsbal Manly and several policemen As the gentlemen were about en- tering they were stopped by the Deputy Mar- shal, who informed them that the rd had adjourned for the day, and that he had received ordersto allow noone to enter. They grace. fully retired, and on oecrene tothe Mayor's office, in the City Hall, were informed that his Honor had gone to dinner. They then re- entered their carriagé and drove off. Messrs. Hindes and Wood, with Mayor Chapman, it is understood, were in the office ef the former when Messrs. Valiant, Young and Carter called and were refased admit- tance at the gate. Itis proper to state that on Thursday evening, about 6 o'clock, the Secre- tary of State, John M. Carter, Esq., served on Messrs. Hindes and Wood the requisite official notice of their dismissal by the Goveraor. The newly appointed ‘d issued an order last night stating that they do not design inter- fering in any respect with the police as now organized, or to lemove amy person connected With it tor his political opinions, provided he does not bereatter render himself amenable to the laws now in force for the government of the police of Baltimere, aud invoking all good citizens to assist them by their counsel and exsmpile, and that they will use their best en. deayors to prevent auy undue excitement, and that they will also advise all disposed wo act otherwise to quietly and peaceably acqui- esce in the measures now about being imaugu- rated by the authority of the Governur. it is understood that the deposed board of commissioners have determined to retain their positions until removed by what they term the due course eflaw. By special invitation, a large namber of prominent conservative gentiemen last evening met Mayor Chapman and Thomas S. Alexander, Esq., one of the counsel for Messrs. Hines and Wood, at the Mayer's oce. They desired, cn bebalf of the old ‘d, to have presented .o them the names of a responsibie conservative in each precinct, in view of theappointment as judges of the election to take place on Tuesday next. in all cases the gentlemen declined naming any one under the existing circumstances. Mr. Alexander expressed his desire to make good his promise during the investigation at Annapolis to giveone conservative judge in each precinct. The gentlemen present assured both the Mayor and Mr. Alexander that even under 4 different state of affairs they would decline to name parties as judges unless every other judge was maa of respectability, and who had sufficient property to make him ame- nable to the law for liction ot duty. Mr, Alexander intimated to the gentlemen present that it was designed to hold the election on ‘Tuesday next under the registry of 1366, and that all parties thus = would haye an opportunity to vote. ‘he meeting is repre- sented to have been of a courteous character personally, but as 4 matter of course nothing ‘was accomplished further tnan a free inter- Toronto, Nov. 2.—It not being unde! thatany Fenians would be tried, the atten- dance at the opening of the court was not very large. but upon Daniel Wheelan being placed in the dock the court rapidly filled and tbe room became crowded. r. The grand jury then entered the room with trae bills against Thomas Cooney, Thomas School, William Duggany, and Jobn O'UVonnor, alt Fenian prisoners. Cooney was then — in the dock and pleaded not guilty. 1s trial was fixed for the 13th instant School was next placed in the dock. He claimed to be an American citizen and pleaded not guilty. His trial was fixed for the 10th instant. Daggan pleaded the same and his trial was also fixed for the 10th instant. Mr. McKenzie then > plied to have the indictment quashed on ground that toe different counts charged the risoners with being foreign subjects and ritish subjects. He submitted that ~~ could not be both, and if held to be Bri subjects they must be indicted for treason. The judge overruled the objection for the pre- sent. Mr. McKenzie gave notice he would move the Crown to elect whether to try them as Britis jubjects or American citizens. His lordsbip remarked he thought it was intended that the metion should be a very proper one, but be would leave the jury to say whether they were British or American su’ ts. His remains were found in the em- bers after the barn was burned down. Curious Law Port.—The Richmond Times says:—Last July a woman named Mar- tha E. Haghes was brought before the Circuit Court of Middlesex county, charged with stealing a lot of wearing apparel frem Mrs. In thetrial the counsel for the accused demanded that the case be dropped on the ground thata married woman’s clothing did not belong to her, but to her husband, and of course his client could not be tried for stealing articles from a person to whom they did not belong. The Circuit Court in sentencing the woman to imprisonment, showed that it was of the opinion that a wife’s clothing did belong to her, and not to her husband. The case has been bronght before the Su- preme Uourt for it to decife whether the wo- man was or was net my sentenced. If it decides that she was illegally sentenced. then it decides awife’s clothing does not be- long to her but to her husband, and vice versa.
