He expressed his surprise that, after a tull examination of the subject, amy committee of this House should even have such & Measure, and said The proposition is equivalent to seizing a very large amount of property invested under a solemn compact entered into between the Government of the United States and the States of Maryland and Virginia. Bat first let me make a remark or two to show the great propriety of such a motion. Two months ago, or more, the Senate, by a resolution, called upen the Secretary of War to Appoint engineers to examine this Washing- ton canal and report a mode of improvement to accomplish two purposes—one in reference to the sanitary condition, and the other in ret- erence to the commercial capabilities of the canal. Those engineers have reported to ( gress a plan of improvement to relieve us all apprehension in regard to the health of the city, such as was felt at the beginning of this session from the condition in which the canal was then found. But they have time to complete their labors long the period to which it is now proposed by the genueman over the way this bill shall be j poned. Mr. Thomas, after reading from the laws bearing on the question, showing that Con- gress could not, properly, interfe: with the Chesapeake & Ohio Canal, said:—Now, wha is proposed in this bill! It proposes to crant to a company of individuals, nine of the num- ber, 2 majority of them being non-residents of the District of Columbia, and none of then being residents of Maryland, not only the po er to hold, ocenpy, possess, ‘and enjo: out paying for 11, the Washingtoa canal, to hold, occupy, and possess ali that part of the Chesapeake and Ohio Canal that lies es< of the western bank of Rock Creek. The canal company have built a dike b»- tween the river and Rock ercek, and tormed a basin. They have coustracted four ver pensive canal locks immediately beyond creek, within the short distance of a quar ota mile. They have built outside of tn Fiediction of the United States, and inside the jurisdiction of Maryland, dam across Potomac fiver for a teeder for the canals. The water from the river, after Sapptving cer. tain factories, furnishes the means of rea ing this basin at the mouth of Hock creek, then passes into the Washington canal. Mr. Speaker, that part of tne Chesapeake and Ohio canai proposed to be seized, ers the west bank of Rock creek, cost only abon one hundred and six or one hundred and eight thousand dollars: and if the parties under this most anomalous bill are called on to pay th amount, what vecomes of the investments the Chesapeake and Ohio canal. amounti ° £510,400 more, expended beyona the west boundary of Rack creek, expended in the cou. struction of canal locks, four in niimber, and bridges over the canal, four in number; whit becomes of that investment! These corpo: tors are not to pay for it. They are to seize as a mere locality that part ofthe property which they need. They are 10 appropriate to their purposes that part of the canal which lies east of the western bank of Reck creek. They are toestop the Chesapeake and Ohio Canal Com- pany from the opportunity of getting into the sin at Rock creek, and of passing out into the river Potomac or into the Washington Ca- nal. They are not to pay the Chesapeake and Ohio Canal Company for their investment be- yond that point. No one will suppose that this company is to be remunerated on an ex- penditure of nearly half a million dollars wy collecting toll upon the articles transported upon the canal for a quarter of a mile. Again, this company now pro; con- all but d t are not Teauireg, and Congress cannot authorize them, to go isfSide of the boundaries of the State of Maryland and take possession of and pay for the dam across the river Potomac beyond Georgetown. within the jurisdiction of the State of Maryland, without which the Wash- ington canal will be of no value; without which this grant will not be worth the paper upon which it is written. Congress is to in- terpose with a high-handed authority and give this new company the right to condemn all that part of the work which the Cnes- apeake and Ohio Canal Company have made up to @ certain point, giving this new com- pany the advantages of all the structures up to that point; while those beyond that point cannot be of any exclusive advantage to the Chesapeake and Ohio Canal Company. And the commerce of the Chesapexke and Ohio Capal y cannot pass that dam and reach a market without paying toll to this new company.
