[From the Indianapolis Herald, Jan. 29.} ‘ An mteresting case is now pending in the Cireuit Court, involving some nice points of law in relation to the solemnization of the mar- Tiage ceremony. Some years since a promi- dent citizen, Mr. Andrew Fuqua, died pos- tesced of cons.derable property. By his will his wife by a second marriage came into pos- session of all his property, which she was to hold during life, in case she remained a widow. At her death, if unmarried, the property would revert to her husband's relatives. Lf she mar- ried, however, one-half the property was to be here to dispose of as she might think proper. Mrs. Fuqua was hopelessly iil with some lung disease, and two days before her death wns in- might thus acquire the title in fee simple to half the property, which she could then deed to her own relatives, instead of allowing her hus- duced by her brother to marry. that s “oe Neen chara band’s heirs to inherit it. Her brother had been a captain in one of the Indiana regiments, and induced one of his men to play the role of husband in the death-bed >» marriage, im consideration of $510 paid down. The arrangement was made, the purehase , money paid over, and the dying woman, una- up im ber bed, was married to the | heartless adventurer, who could thus make merchandise anda mockery of the most solemn ent recognized in the civilized world, ony being performed by a minister of ho, it would seem, could not bave ther ignorant of the nature of the | transaction. Atany rate, the husband, after | the ceremony, left the bonse, went on a spree with his $590, and neversaw his wife again, who died two days after. He never slept a - Bight beneath her soof The action was brought by Mr. Fuqua’s relatives to contest the validity ofthe marriage. The best talent is employed on both sides, and the case will undoubtedly prove one of great interest to the public as weil ble to sit eacr: the cere &@s the legal fraternity.
