Laskey, an attorney, ‘was placed upon the stand as a witness for the defense to testify what transpired between bimeelf, associated with Mr. Davidge, and Mrs. Brown, they at the time being her legal ad- Yicers. Mrs. Brown, on her examination, was asked hy she had not returned to the Orphans’ Coart, inher petition for letters of administra- — that Emily J. Wiley was next of kin to Geceased, and in reply she stated that she was advised by ber attorneys, Messrs. Laskey and Davidge, that Emily, not being born in wed- lock, was not tobe considered as next of kin, nd that her return was made in pursuance of such advice. The defense urged that Mrs. Brown had, by her voluntary testimony concerning the advices Of her counsel, waived her right to demand lence on this part: that she could not claim to seal their lps, after having, without claiming the protection of her privilege, herselfdisclosed the fets or a portion of them. The Court suggesisd that, as it had before in- mated, the privilege claimed did not extend to the client; that he ‘would be compelled to an- Swer any question as to what passed between himeeif and his attorney; but that the principle was grounded in public policy that an attor- ney’s lips were forever sealed as to interviews between his client and himself in his profes- sional character or capacity. Counsel for defence insisted that, by English and a number of American authorities, the }vilege extended to the chent was mutual, and that he could not be compelled te disclose an opinion of his counsel or the advice of his counsel: and that, therefore, when he did vol- untary do so, he removed the veil of secrecy from the whole matter, and relieved his coun- sel from his obligation of secrecy; that this vol- Dntary act was a waiverot his rights as against the diselosures of his attorney. After further argument the Court remarked that it would bold the question under advise- Ment until Monday AN INTERBSTING Cas vs. Louisa Hays: before J The case was this:—The plaintiff's wife sent a silk dress, worth £100, to the defendant, upon which the defendant advanced 350, promising to take care of the dress, &c. Afterwards, the plain- tiff called upon the defendant with the money and demanded the dress, offering to refund her the $50 and all interest that she might think Proper to charge. The defendant refused to produce the dress, stating that the dress had been stolen, &c., and this action was brought to recover the sum of $50, which, with the $50 previously received from the defendant, made up the amount which the dress cost. The writ of summons tn this case was special, i. ¢. it was issned by Justice Miller, and commanded the defendantto appear before him for trial, &c., and the Gefendant, by her counsel, asked leave to have the case tried by some other justice, which was refused, and the defendant's coun- sel also denied that the Justice had jurisdiction to try the case, but the plaintiff, in support of the jurisdiction, relied upon the act of Congress of March 1, Iv3, sec. 1, stat. 743, which gives jurisdiction to Justices of the Peace, “in all cases where the real debt and damages do not exceed the sum of $50, exclusive of costs,” and npon the actof Maryland, of 1791, ch. 68, sec. i0, which provides, inter alia, that the jurisdic- hon of Justices is “deemed, construed,and un- Nerstood to extend only to debts, or sums of money, or tobacco, due upon contract, and to damages for th non-delivery of grain, or other articles cont ed to be delivered.” The plea to the jurisdiction being overruled, the defend- ant then put in the plea of coverture, and testi- fied that she was married to a man “down South,” in the year 1537, and upon being inter- Togated as to how long it was since she lived with him, she refused toanswer, and the plain- tiff's counsel proposed to show that she was and had been living separate and apart from her busband for many years last past, and maintained, as well settled law, thata woman, 80 living,could sue and be sned as a femme sole; Wherenpon the plea of coverture was with- drawn. Tux Cororep Scnoots or THE Crry.—A Meeting of the trict of Columbia Educa- tional Association” took place yesterday after- noon in the hall connected with the Free Library Rooms on Judiciary Square. There ‘were upwards of eighty teachers present. It was the third gathering of the kind, and the full organization of the association was com- pleted, and much business of interest con- mected with colored schools of the city and Vicinity transacted. Rev. John Kimball is pres- ident, John Cook vice president, and A. Newton secretary. The purpose of the society is the promotion of an acquaintance among the teachers engaged in instructing the colored people, an interchange of views in regard to iheir work, apd the general welfare of the common cause. There were, as already stated, upwards of eighty teachers present, some af teen of them male, and the remainder of them female teachers. Some ten cr a dozen of the pomber were colored teachers—mostly, like Mr. Cook, natives of this city—and several of them teachers of private tuition schools. Lewis, who charged Mr. Brooker “ with felo- rrously and unlawfully cheating and swindling him in the purchase ef a quantity of sugar, both in quality and quantity, and knowingl. th ef November, I-65.
