CANTERBURY.—The dramaof “The Female Oteeks of Washington, or Early’s last Raid,” aad a huge programme of ballet, songs, Ethio- pam delineations, &c. - — The Outrage on Little Octavie Rousseau. eae TRIAL OF LUSBY—VERDICT OF “NOT GUILTY.” Criminat Court, Judge Wylie—The trial of this case was resumed this morning, and Mr. Wilson, Assistant District Attorney, proceeded to deliver the closing argument to the jury. He first asked what evidence had been adduced by the defense to modify the case made ont by ike prosecution, and spoke of the enormity of the crime. A litte innocent girl leaves ber father’s house; in a little while her infe is trampled out in a miry mass of blood, and her little lifeless body lies on her mother’s lap. Although a year has passea since the soul of the little victim bas taken its flight, yet the trator of this foul crime sets in the prisone: dock. It is ‘rue efforts have been made to bring the pris- oner to trial, and in a case like this jastice does not set witharms folded. From thé arguments on the other side it would appear that Messrs, Wise aud Allenare the guilty parties. They did find out the guilt and the prosecution were not ashamed of their efforts. He would not as- sail their witnesses as they had assailed those of the prosecution, but would sim- ply confine himself to the question whether the prisoner at the bar caused the death of the deceased. If you had seen the lot deseribed by the detectives, and they were to ascertain who committed the act, they would tirst inquire whether the prisoner was there, and expect to find the same material on nis clothes—blood also on them; that he had been under the influence of liquor, and finally be- cause the human keart can never keep to itself its dread secret: that he had said some word aboutit. Mr. Wilson asked if all these had not been proved, and proceeded to speak of the bloody shirt shown the witness, Mrs. How- land, apd the conduct of the prisoner when Mrs. Howland was telling the wife of the oc- currence, which he thought proved that at the time the gnilty party was under the roof. The defense attempted to meet this witness by proving the bad feeling she had for the pris- oner, and in his opinion there was reason why she should hate the ground he walked on. ‘Tuesday night comes, and in the meantime the officers have been informed of circumstances which tend to show that the prisoner is the guilty man. Mr. Wood takes with him three men who had long known the prisoner to make the arrest, and his conduct was such as to con- firm their suspicions. Tbey carried him off, and when they searched the house three gar- ments with blood on them were found. This blood did not come down from Heaven,and these garments had a counection with some person, some time and some place. There was no satisfactory account given as to bow the blood came upon his garments, and be contended that there was no reasonable or accountable way of acconnting for it but b: the supposition that the prisoner got the bloo at the ume the crime was committed. Shafer testified that the accused, when he saw him, Was going in the direction of where the erime was committed. Emma Ingle identified the wer as being within a square and a half, and others testified to his being in the same n referred to the evidence of Rodgers and Watson, the pardoned convicts, contend- ing the prisoner told them ail that was neces- sary to fix the crime on him. Men charzed as the prisoner never tell persons who move in the higher walks, but to men of their own choosing, knowing that should they be called to testify against them some zealous connsel will be on hand to assail them. The evidence lexander did not conflict with theirs. Mr. Wilson referred to the evidence of the oe print in the mud, and said if the prisoner not worn a shoe auswering the description as easy for them to bave proved it.
