THE ALLEogD Post Orricg Ronpany.—Yrs- Berday, the case Obariee W. Spencer, A Wes arrested several weeks since on the charge 0 concerned in the Pi robbe: pS es A up before Jn as sone at hh , Diermeble appearing for the Sccused. Ip will | be recollected that Mr. Spencer was employed | im the City Post Office, and that W.D.Cudlipp | “was first arrested on the charge of being con- cerned in abstracting the bonds, -by Messrs. | Smuh sod Gray, Baltimore detectives. Cudlip | ‘Was confined in one of the Baltimore station | Bouses and made his escape. Spencer being | ‘well Known im this city t@@ examination at. | tracts a large number of spectators. Mr. Utermenie objectet %0 the trial proceed- ang only as to Spencer; but the justice overuled the objection, and the trial proceeded as if both | parties were present. if The first witness called was Detective John | W. Smith, who testified that Mr. Gay and | bimself, in tbe latter part of April, went to ‘Westminster to look after the bank robbery: that while there he met W. H. Irving, who had been arrested on being concerned in the bank robbery, and that on asking Irving about it he said he knew nothing of it, but he had a case for witness, and he gave witness an envelope dox containing postage stamps, which hestatea he bad receivedin Baitimcre from Washington. Irving, he understood, said that they came from Unudlipp, and had en taken from the Post Office. Irving and witness came down from Baltimore about the !6th of May, Irving coming down one evening and witness next | morbing. Irving stopped at Cadlipp’s house, | ud in the morning, after having met wituess, | he went back to the house (Cudlip’s) and brought to him stx 1,000 Treasury bonds. Witness here identified the bonds as also a | letter of the Commercial Bank of Albany, | dated May lth, enclosing the bonds to tne | Treasury Depariment for redemption Wit- ness went to Postmaster General Dennison | and an investigation was made. They went to | the Treasury and were informed that trom | 160,000 to 170) 000 dollars in bonds were missing. | Witness had made an engagement to meet | With Irving at the Post Office restau- Fant, but having staid longer at the Treasury than he at first supposed he got there too jate. While at the restaurant Spencer came in and asked it he was looking for | Irving, and witness replied in the affirmative. Spencer said he had promised to meet him there at J o’clock. Witness walked down to the corner of the avenue. andina few min- | Utes Spencer appeared again, and said that he ‘Was to meet Irving there. Witness told Spen- cer to tell Irving that he was going to Buiti- more, and when witness went to the depot he saw Spencer come down. By Mr. Utermehie:—Witness received the stamps from Irvin at Westminster. Witness found nothing in Spencer's house to implicate him with Oudlipp, except a photograph of the two on one card. By Justice Jonnson:—Irvin sent a telegram to Cudlipp to meet him at the Garibaldi House, in Baltimore, which Cudlipp did, aad Cudlipp was there arrested. He was taken to the Western Police Station, from which he escaped, and has not as yet been recaptured. Wm. H. Irvin, of Westminster, Carroll county. Md, was sworn, and testified that he met Cadlipp in the cars between here and Balti- More, and told him he was in want of means Usdtee seid if he came to Washington he would help bim, and subsequently he wrote to Witness to come to Washington. When wit- mess came Undlipp told him there was money in a certain hotel. (Gale’s,) and that he must run his chances, and they wonld settle the expenses. Witness went to the hotel, but finally gave up the job. That night witness went to Canterbury, when Cudlipp said to Spencer, “Spencer, you promised to pay part of the expenses of this affair,” and Spencer gave witness a dollar. Witess went to his Some in Carroll county, and from there to Finchburg. While at the latter place he saw “udlipp come up the road, and he told Cud- lipp he was glad to see him; that it should wet cost anythiug while he was there. Oud- lipp said he would pay his expenses, as he had plenty of money, showing 4 lot of bonds. They afterwards went to a tavern near Baltimore, and Cudiipp said he was fe, and New orks to Pay some mn wiodnce tis the substitute business. and he wished wit. ness togo with him. Witness con: nted to go. After they reached Baltimore. Cudlipp showed witness a number of bonds, one of which was 8 gold bearing bond; he here gave witness & $50 bond and told him what bank to go to and get it cashed; witness returned with about #37 for the bond. when Cudlipp told him there was & premium on the bond, that he should go back and have the mistake rectified; he went, and returned with 5+, having re- ceived $3 premium; in Philadelphia he gave ‘witness four £50 bonds to take to Jay Cooke & Co’s and have cashed; this he did, getting a premium, and turned itoverto Oudlipp. On the 3d of March, in New York, Cadlipp re- quested witness not to introduce him, us he was inthe substitute business, and had for- ™erly been on the detective force in Washing- ton. Before leaving New York he gave wit- ness more bonds to get cashed, but the cashier ‘would not cash them uniess he procured some one to identify him, and say where he belonged. He informed Uudlipp of the facts, when Oud- lipp wanted him to goto his friends and get some one to vouch for him. He afterwards told witness he need not go, and while passing along the streets, requested Irvin to go into a ry store and price a certain diamond pin. itness bought the pin, and gave it, with the ehange for bond to Cudlipp. At 12 o’clock that night, he and witness took a train of cars and came to Balumore, where Cadlipp gave him some money, and promised to call at his ome in & short time and see him. In a abort time witness received a letter from Cudlip telling him to come to Washington and Witness came down, when Cudlip gave him a package of mutilated currency and told him to get itexchaxged and he took it to a bank near the Treasury and received #27, which he handed over to Cudiip. Just before he left the city Cudlip gave him a box of postage stamps telling him they had been left of alot he had in the army; that there were 9,100 in the box, which he couid sell tor2% cents apiece. After witness got home he found there wae but little over 4,000 in the box. Soon after the bank in ‘Westminster wes robbed and witness with others w&s arrested and released. Witness saw Detective Smith the following day, and told him he had intended to call on him about the stamps. Witness here stated that Cadlip | offered bim one-third of the money he raised on the bonds he might disvose of. One of the six bonas shown the court was here exhibited | to the witness, who pointed where a chemical process had been applied for the purpose of | obliterating a signature, saying that hesaw the acid appiied by Uudlip before it was turned over to him by Cudlip. Cudlip told witness | that the bonds bad been bagged by Spencer; that barf had come in Adams & Co.'s express, and said that Spencer would beganything. Witness said he believed that he and Spencer were both dupes for Cudlip. Witness took the bonds he re- ceived of Cudlip toa hotel, and gave them to the clerk to lock it up, at same time ep lorsing the amount. Cudlivp afterwards said he must have them, and witness said he would get them next morning. Next day Cudlipp threatened to kill him If he did not get them, and witness stepped away from him, but Cudlipp again met him, and with a friend commenced palling witness tewards his (Cudlipp’s) house, when he broke away andran intoastore Two police- men appeared and witness called on them for Protection. Cudlipp wanted the police to take witvess to his house, but witness wanted to go to the watch house, and was taken there. Be- fore this melee Spencer gave witness a lot of postage stamps near the Post Office Restaurant, saying he had no use for them. Witness saw Cadlipp in prison in Baltimore, and Cudlipp said be did not know what he was arrested for unless for the assassination, as he had several times drank with Booth. Cuadlipp expressed & des ire to get ont, as bonds to the amount of $75,000 were expected by the 2d of June, and if none Not get out by that time he would lose By Mr. Utermehie:—Witness had assumed ae of W.H.
