Sui Se CONCLUSION OF YESTERDAY’S PRO- CEEDINGS. ‘ —--—»—— -- Our reportclesed yesterday with that part of Mr. Ewing’s argument in the case of Spangler, a8 went to show that the accused was not absent from his post on the stage on the night of the assassination, ard that Spangler had no partin the crime. Having presented all the evidence bearing upon the acts done and Words spoken by Spangler up to that time, Mr. Ewing proceeded to discuss his conduct until bis arrest,on the 17th of April, at his boarding-house, where he had lived for five or six months. During the three days and nights intervening between the assassination and the arrest, nothing was done by Spangler whick did not indicate a conscious sense of innocence. He felt confident in the assertion that Booth had no accomplice—he did not need any. Booth had played atthat theatre,and by courtesy had free entrance; therefore, he had made his own preparations. The leap from the box to the stage was one which might have been made by any man with safety. Had not his spur canent in the flag, Booth might have made th.s ieap with ease. The connsel was confident that Booth needed no help but some one to hold his horse,.which Peanut John did, and he opened and shnt the door for himself. It appeared from the testimony of{Mr. Hess, the manager of & rival theatre, that Booth in- quired particularly of him whether Grover's Theatre was to beilluminated, and whether the President was invited on the occasion. From the testimony as to Booth’s inquiries, it seems clear that the assassination of the Presi- dent wonld have been attempted at Grover’s Theatre, had the President attended that house on the nightof the illumination Mr. Ewing examined at length other parts of the testimony, and concluded by saying he could see in the evidence no suspicion as would induce a grand jury to present Span- gler for trial, and he believed & candid review of the entire subject would leave in the minds of but very few a reasonable doubt of his inno- cence. Colonel Doster stated that he would be prepared to read the argument for Payne to- morrow. General Howe said that the Court had already extended the time for the arguments. If they were not all presented to-morrow, let the remainder be filed. With these delays they might not get through till autamn General Eakin said he was willing to grant ali the time the counsel asked to prepare their arguments on subjects of this impor- tance. General Hunter said the testimony was very voluminous. Mr. Ewing remarked the labor of prepa- ration was greater than supposed It would be out of his power to prepare Dr. Mudd’s de- fence before Friday, as there were over two hundred and fifty pages of evidence in that case. The court yoted to grant an extension of time for the preparation of the remaining argu- ments, and then adjourned till noon to-day. THE ROXBURY TRAGEDY. Mass., involving the death of Joma S. and Isabella Joyce, mentsoned in the Star’s dis- patches yeeterday, has created a great excite. ment im that section of the State, ana the en- tire police force are in pursuit of the authors: of the outrage. The body ef the murdered girl was feund about 1 o’clock Sunday afternoon in Bussey’s ‘woods, & very secluded place, at no great dis- tance from the road. The girl was in her fif- teenth year, but was remarkably well-formed, round and full in person, over five feet high, and rather attractive, with auburn hair and very clear, bright eyes. The boy, two years younger, was small for his age. The place where the murder was committed ‘was & litle peyond the Forest Hills station, at the juncture of the Providence and Dedham Railroads. Beneath an old oak tree, on an eminence in the grove, isa piace favorable to a seat, where:the girl had evidently sat work- ing. Her body was found fiat on the back, from twenty ‘o fifty feet distant from the seat, and her underclotheg torn off. The wounds on her person (twenty seven in number) were in different places, extending from the hips to the breast bone, and one or two on the back. From an examination of the body, Doctor Stedman was ied to infer that but one person was engaged in the outrage. The wounds Were deep, and were made evidently by the same jnstrnment that killed the boy. The young girl mus! have made a des te strug- gle to free herself from the hands of the villain, asthe leaves and ground near the rock are clotted with blood, from the twenty-seven ‘wounds received upon her body, from a large dirk knife, sixteen of them being upon her back. She raust have also made an attempt to grasp the knife of the murderer, as one of her fingers on the right hand is severed, and all fhe others are nearly cutoff. Her clothes were soaked with blood. Her mouth was dis- covered to be full of grass, which had been employed to prevent her outcries from being eard. It is supposed that the boy was fora time amazed or paralyaed by the attack on his sis- ter, and that when he turned to run it was too late. His course was down the hill toward a brook and toward Mr. Motley’s house. There were two houses within a few hundred yards of the scene, but the inmates are so accus- tomed to shouts, laughter and yells from pic mic and excursion groups that they would not have paid much attention if they had heard sce on this occasion. The boy was no doubt killed after he fell, the murderer stoop- ing down. The wounds were eight ‘inches deep, zoing clear through the body, and in one of two cases the point coming through the skin in front. Although the wounds in both bodies appeared to have been made b; thesamesharp instrament, it is believed that at least two Rereces were concerned in the tragic uffair. he corpses are so decomposed that it is: im- possible to expose them to public view. Re- wards amounting to $5,500 have been offered for the apprehension of the murderer. Several parties have been arrested, but none of them are yet ascertained to be implicated. Some little stir was created in the city yes- terday by the report that Colonel Mosby, the celebrated partisan chieftain was in Lynch- burg. Various rumors were afloat as to the cause of his appearance, but the following are, we believe, facts of the case: Some days since Colonel Mosby’s brother came to Vaptain Swank, Provost Marshal of this city, toinquire if Mosby would be paroled on pao and surrendering to the authorities. aptain Swank replied that he would make inquiries upon the subject, and give him an answer in afew days. Day before yesterday he again called to see the Marshal upon the subject, and was told tnat Colonel Mosby would be paroled if he would come in and give himselfup: {n accordance with this information, Mosby came into Lynchburg yesterday and applied at the Provost Marshal’s office for a patole.
