Spencer, was resumed at noon at Justice Johnson’s office. Mr. Utermehle, for Mr. Spencer, said he ‘would offer the folowing to rebut the testi- Mony for the prosecution, and he called Mr. James A. romans mre aeeee that the Pos: stamps in city post office are in enarpeoe the dnancial clerk, and thstat present he has charge of them. They are delivered to the stamp clerks, Messrs. Underhill and McClellan, as they are needed. An examina- tion had been made, and he was satisfied that the stamps had not been abstracted from the office. He had never heard of the abstraction of bonds. except what he had heard in con- nection with the case. Joseph F. Hodgson testified that he has known Mr. Spencer for seyeral years, and bas un- bounded confidence in his honesty. While witness was employed in the post office he frequently left the money for the Treasury in charge of the accused, and none was missed. Mr. S.J. Bowen, ( Postmaster, ) testified that the accused was one of the clerks in the newsps- per department, aud he had nothing to do with the letter branch. Sometimes bonds, how- ever, came among the papers by mistake. There has been registered letters missing, but it had never been ascertained whether they had been lost. Witness removed the accused, but not because of any suspicions as to his honesty, subsequently reinstating him. After the charge was made witness took an inventery of the stamps on hand and found that there was not aperny’s difference with the book account. Witness bad not heard of the loss of more than Sli in stamps during the last three months, and this loss took place out of the office. Wit- ness understood that neither the Georgetown or Alexandria offices, which are supplied through Washington, have missed stamps. The Justice here remarked that he was satis- fied that the evidence was insufficient send the case up, €no remarking that Mr. Spencer was culpaole for keeping company with per- sons of the character of Irvin honorably ac- qnitied him. Mr. Jonn J. Joknson appeared for Cudlip, and asked leave to offer evidence to rebut that of Mr. Irvin. but the justice decided that he would not then hear such evidence, preferring that when Cudlip is re-artested that the case come up de novo. THE New Market ReGULaATioNS.— The police have given an indication of the course to be pursued in all future cases of violations of the new market regulations. Tuesday, Wm. Jole was arrested by patrolman Brown for being drunk and smoking a cigar in the mar- ket-house. Justice Buckey assessed the pen- alty at $10.44. Wm. H. Robertson, for buying produce in market hours and selling the same, was arrested by officer Lipscomb. This is what is krown to Washington magistrates as forestalling the market. The penalty in this case also was $l 44. This system, strictly ad- hered to, will protect dealers as well as citi- zens. The old habit of purchasing produce and delivering in the market is also prohibited by the new regulations; so that there is no dodging the law, which gives the citizen the opportunity of buying directly from the pro- ducer. The dealers will have equal chances ot getting supplies before the market opens and after it has closed, if they wish to purchase what is brought totown by wagons. Most of them, however, are not obliged to rely upon the small Jots thus offered, they making their arrangements with the producers to send them supplies as they are needed. The strict en- forcement of the new regulations is expected by the Corporation and the police will not dis- appoint them. THE WAY OF THR TRANSGRESSOR Is HARD. James Walsh was arrested by the military yesterday for selling liquor to soldiers, and took him tothe Central Guardhouse, where he was fined $25. This morning he was arrested again by officer Lipscomb, and was iaken be. fore Justice Buckey, who fined him $20.14 for selling whisky without license: and for selling groceries without license, #5414. His business is rather unprofitable, as the same dose wili be repeated until he complies with the law. CanaL.—The arrivals reported to-day are E.H. Tracy and G. W. Hetzer, with wood, apd the J.G. Morrison. with wheat and hav for market, all from ports within forty miles of this town. The reason of this falling off is the breach about sixty miles from this terminus, which is undergoingrepair. Three boats laden with coal have been added to the list, but they passed Antietam division before the breach. They bring 110.3 tons to the New H Co; 106 16 tons to Cumberland Go.; and 109 tons to Geo. H. Plants Departed —Advance, with flour, toGumber- land, and seventeen boats light Tue New License LAw —According toa recent act of the Corporation, all butchers, hucksters and others doing business appropri- ate to the market-houee in any other place than the established market are required to pay a license of $S0 per annum, as do all green gro- cers, and the penaityis aftine for every day such business is transacted of not less than five nor more than twenty dollars. Fis morn- ing, Warrants were served by patrolman Frid- ley on Jacob Hommiller, Thos. Smoot, Francis Gross and John Zeabower, doing business in the old warehouse. The officer gave them the privilege of going to the station-house without being accompanied by him, as the offence charged was committed yesterday. The butch- ers took time to go the clerk and get their li- censes from to-day, And then presented them before Justice Buckey. These licenses would not necessarily relieve them of the penalty, but the Justice dismissed the cases against them. FLourR AN® GRa‘N MARKBT —There are no arrivals of flour reported, and no transactions in flour or grain to justity a change of yester- day's quotations.
