Mrs. Surratt, as on yesterday, was permit- ted, on account of indisposition, to occupy a seat in the passage between the court room and the witness room, for the benefit of fresh air. Mr. Ewing said that in what he had to say in behalf of the prisoner, Edward Spangler, he would contine himself toa review of the evidence, reserving what he had to say in re- gard tothe jurisdiction of the Court and the character of thy- charges and specifications un- Ul he shouid present his argument in the cases of Mudd and Arnold. He first considered the character of the ac- cused, his relations to Booth, and Booth’s habits of resorting to the theater and frater- nizing with the empioyees. Mr. Ewing proceeded to detail the testimony ot John T. Ford as toSpangier’s position at the the theater: the fascinating influence of Booth over the lower classes; and the good natureand Kindness of heart of Spangler. There was not, Mr. wing urged, the slizht- est indication in the evidenee that Spangler ever met Booth except about the theater, or that he was in any manner implicated in Booth’s plans. Nothing appears in ary of the evidence, except that of Dye and Sleightman, to show the slightest knowledge by Spangler ot Booth’s guilty purposes. The act of Spangler in repairing Booth’s stable was the act of a drudge; and the fact of his taking Booth’s horse and buggy to the horse market was as goodagainst J. R. Ford and Gifford as against Spangler, but in fact, told nothing against any of them. The rope tound in Spangler’s carpet bag was just like 40 or 50 others about the theater, used as bor- der ropes. From the evidence it would appear that he had stowed it away for ble fishing excursions as a crab line. In that devilish scheme for the assassination of the President he could imagine no use to which that piece of rope, 51 feet long, could be used, and if used at all in that con- nection, its proper place would have been at the theater, and not at Spangler’s boarding place. He (Mr, Ewing) had feltsome embar- rassment in being able to explain exactly how the prisoner came legitimately in possession of this rope; but it should be remembered that the Court had not required an explanation as to the equally suspicious and incongruous arti- cles tound in Spangler’s carpet bag,—the shirt collar and writing materials. peenaaier, in which the shirt-collarless Spangter joined. } The teetimony of Peanut: as to Spangler’s cursing the President whiie preparing the stage box would not goa great way as evi- dence; but as an offsett to it, supposing him to have used the language stated, and under the irritation caused by being called from his regular work to prepare the stage box, we have the faci of his having clapped bis hands when the President: entered the theater, seeming as rejoiced as any one. he fact that Booth did not want the saddle and bridle taken from his horszeand that Span- gler wanted to take it off and subsequently did so, showed thet Spangier had no idea of Booth s purpose. The preparations for the assassination fin connection with the stage box also testify in Spaugler’s fayor. The evidence shows that Beotn had occupied Box No.7 previous to the assassination; that he always engaged that box, and that he had done so to make his prep- aratons. These facts teth in Spanglir’s favor, as show- ing that Spangler was not a confederate of Booth’s, else he would have been delegated by Booth, work instead bim- self. The fact of the screws being loose in the box door was shown by the testumony of Raybot to have been caused by his bursting open the door on & previs us occasion. As regards the bar produced in Court, it is evident that it was not prepared specially for the purpose, and that if it was really the bar used it was not prepared by Spangier, as he, arpenter, would not e gigarpenter, Would not have prepared it so The testimony of Slightman as to Spangler saying Yes” to Booth’s request to help him all he could at the time Booth rode up to the rear of the theatre, 1s positively contradicted by the testimony of the utility man, Derboni. ‘The evidence shows conclusively that Booth came to the house with his horse but once that night, and thus Booth could have had no pre- vious opportunity to communicate with him that night. Slightman’s testimony is unsup- ported by the other evidence, and inconsistent with it. Spangler’s whole conduct, both be- fore and after the fatal shot was fired, goes to show that if he did answer affirmatively Booth’s request, he did act comprehend what it meant. The fact that Booth knocked the horse-holder down on emerging from the the- ater shows that Booth, who naturally supposed it was Spangler he was thus striking, had no complicity with Spangler. Mr. Ewing then reviewed the testimony of Sergeant Joseph M. Dye. as to seeing & roughly dressed man in front of the the. ater with whom Booth whispered ere en- tering the theater, previous to shooting the President. Dye swears positively that the roughly dressed man wore a heavy black moustache. It is positively shown that Spang- ler wore no moustache on that night, and was never known to wearone. The fact, too, that Spangler could uot have been absent to the front of the theater for three quarters of an hour from his duties, was also conclusively shown Mr. Ewing was proceeding with his argu- ment when our report closed 402 THE BATTLE FLELDS. ARREST OF A REBEL SENATOR. The Rebel Senator Henry O. Burnett, of Ken- tucky, wlio took the oath of allegiance here yesterday, was arrested at Willards’ Hotel this morning by order of the Secretary of War, The epecific charges against Burnett, who up to 2 o'clock this atternoon was yetin custody at the Provost Marshal’s Office, are not made public. THE FORTIFICATIONS OF WASHINGTON, The forts and fortifications around Washing- ton are to be dismantled and reduced to the number of twenty-two, which are to be im- proved, stvengthened, aad so constructed as to Yorm a complete circle of the city. A large force is to be set to work immediately to ac- complish this end. THE RECEIPTS, The receip's from the sales of Government horses and mules now going on here, begin to realize & handsome sum, about two hundred horses and mules being disposed of each day, at 1air prices, averaging probably about 260 per animal. As those now offered are in a serviceable condition the sales attract large crowds, and the bidding is quite spirited. MRS, SECRETARY SEWARD. THE COLORED PEOPLE AND THE PUBLIC GROUNDS.—A statement has been going the rounds of the papers to the effect that on Sat- urday last the colored people of Washington asked permission of President Johnson to cel- ebrate the ith of July on the grounds attached to the White House, which request the Presi- dent refused to grant, because he considered the grounds public property, of which he was merely the custodian. We have authority for stating that the Rey. Dr. Garnett, of the 15th street Presbyterian colored congregation, made application in writing to the President to allow the members of his church to celebrate the Fourth on the grounds adjoining the White House, which request was granted, the President returning the application to the Ray. Dr. Garnett witha favorable endorsement. DECREE OF REsSTITUTION.—On Saturday, in the Admiralty Court, (Judge Wylie.) a decree of restitution was made in the case of the United States vs. fatboat (no name) captured by the U.S. gunboat Mercury. A mannamed Marcus Myers was on the flatboat at the time of capture, who had in his possession $2,5() in coupons and promissory notes, which were also libelled. The case was argued by Mr. Wilson, Assistant District Attorney, for the Government, and John J. Johnzon for the respondent PATENTS.—To-day the Patent Office issued 160 patents, the largest number ever known. TuR- NER—He is Returned to Libby Prison.—Yester- day morning, it was reported that Richard Turner, in Confederate times the chiet jailor at the Libby Prison, and late a prisoner in the same place, under Federalauthority, had been recaptured. He was taken at his owa house on Union Hill, between one and two o'clock yesterday morning, by some of the provost guard anda detachment sent specially to ar- resthim. He was sleeping with his wife, it is said, with three pistols under his head, but he had time to use neither of his weapons. Itap- pears Turner left the city after his escape, but returned in disguise,asd has since been se- creted at home. His presence was detected by his clothing, which was sent out to wash with his name upon some of the pieces. His wash- erwomen betrayed him.
