Music, supper, rare fancy articles, and a host of other attractions. ag CovxotL PROCEEDINGS, March 6, 1565.—Board of Aldermen.—The Board of Aldermen having at its Iast meeting adjourned ever for two weeks, (non-concurred in by the lower Board,) there was not a quorum present, aad the Board meets again to-night. Common Courncil.—The Board was called to order by the President, (Mr. Lioyd.) In the absence of the Secretary, Mr. H. Lyles was Appointed pro tem. A message was received from the Mayor, Announcing his approval of the following acts: Authorizing the water mains to be laid along 7th street, trom M to N streets north; on 0 Street, from 6:h to 7th: along L0th, from M to O, and thence to Sth; for the relief of Wm. Noting- bam; for appointment of a committee of recep- tion; jeint resolution in reference to the inau- guration. Also, a message informing the Board that the bill amending the act incorporating the cit- ivens of Washington had passed Co gress and — signed by the President, and was now & aw. ‘The Mayor says: ‘This bill gives to the Cor- poration the power which it has long sought, to cause the foot and carriage ways to be graded and paved; the necessary ¢rainage and sewerage facilities to be introduced under and vDpon the streets, avenues and alleys; to cause the same to be properly cleaned and cause lamp posts to be erected thereon and light the same, and to pay the ex pense thereof; authorizes the Corporation to lay and collect a tax upon the property benefitted by any such improve- ment. To make a commencement under this law, I would respectfully suggest to you the propriety of passing an ordinance to have all the streets intersecting Pennsylvania avenue, from Ist street west to 2th street west inclu- sive, at least three squares north and two po abe scuth of that avenue, paved immedi- ately.” Referred to committees of Improvements and drainage. The Chair laid before the Board a commu- nication from Sones ard Ashford, counsel for J. R. Murray, in relation to certain unredeemed certificates of stock; referred. : Mr. Larner introduced a bill to defray the expenses incurred on the ith inst, which was ara d—Mir. The following bills were reported from com- mittees and passed:—By Mr. Larmer—To pave alleys in square 5:2; to cause the curb to be set and footway paved on N street from New Jer- sey Avenue west; to cause curb te be set and footway to be paved on N street from 7tn to 9th street; tocause curb to de set and footway paved on both sides of G street from 9th to 10th street; to cause curb to be set and footway Paved on the west side of Sth street from N to U street; to take up and relay gutter on the east side of Lith street from F toG street. By Mr. Wilson, (drainage)—Bill for water main in 20th street west from F to Estreet. By Mr. Kelly, (claims)—Bill for the relief of GC. H. Borger (The bills reported from the improvements committee are under the new law of February 23d, 1562 —RepP } The bil! for the relief of John H. Obertueffer was taken up as unfinished business. (This bill is to reimburse him for damage sustained by his carriage being run into an excavation for asewer which, itis alleged, was left un- protected.] After some little debateand a num- ber of amendments had been offered and re- jected the bill was passed—yeas 11, nays 2, (Messrs. Edmonston and Peugh.) Mr. Peuch, from the committee before Con- gress, reported back two resolutions of instruc- tion—one in reference to granting franchises, and the other in relation to the quota of the city—and the committee were discharged from further consideration. The following were received from the Al- dermen:—Bill in relation to the erection of a public school building; referred. Bill to lay Water main on 6th street from New York ave- nue to O street, with au amendment; ¢oncurred in. ———— Casrs oF LanvLorp ann TrNant.—John Wilson ve. — Miller. The plamtiff in this case gave one montis notice to the defendant to re- move from and quit the premises in question. maintaining that the tenancy was monthly: and that if it was not a monthly tenancy, he was nevertheless entitled to the possession, under the proviso in the first section of the act of July 4th, 1564, by reason of alleged -:wasie.” The case was tried before Justice Hollings- head, when it appeared in evidence that the premises in controversy were rented to the de- sendant several years previous, at an agreed to price, payable monthly, and that there was no written contract, and no time specified for the termination or duration of the tenancy. M. Thompson, Esq. the counsel for the de- fendant, argned that the charge of ‘:waste” Was not sustained by the evidence, and ar- gued and quoted Tayler’s landlord and ten. ant, pp. 32 and 33, and authorities there cited, to show that the circumstances of the letting created a tenancy from year to year, which could only be terminated by six months notice to quit; butthe justice gave judgment for the plaintiff, and the deendant appealed to the Cireuit Court, but before the case came on to be tried, Wilson consented that the judgment below should ba reversed, with costs, which wss done. The plaintiff (Wilson) paid the costs, and it is understood, will proceed to give tbe six months notice to Miiler toquit. Case of landiord and tenant, before John H Goddard, Esq. Wm. Johnson vs Wm. Taylor. This was cisimed by the piaintiff to be a monthly tenancy, and one month's notice was given accordingly. lt appeared by the evidence of the piaintiff and defendant that the prem- ises in question were rented to the defendant some two or three years previous, at anagreed price payable monthly, but that there was no written agreement, ani nothing said by or he- tween the parties 3« to the duration of the ten- ancy, and th’s it was argned by Mr. Thomp- son, E-q., counsel for the defendant, created a yearly tenancy by intendment of law, aad that | six months sotice was necessary to terminate it and to enable the landiord to recover posses- sion, and the Justice so decided, and accord- logly gave judgment for the defendant. —= Matinex at Miss Evana’ Sonoor.—Yester- day afternoon the young ladies of the Female German Schovl, First District, gave an ex- hibition inthe echoolroom on Hstireet, which was Iorgely a'teuded and gave general <a'is- faction. The exercises con- sisted of singing, reading of compositions, &c., some of the latter being pieces of high merit. At the close the scholars were addressed by Hon.
