LOCAL NEws. seein HEARING IN THE CASE OF James DINGLEY, CHARGED WITH PUSHING A NEWSBOY FROM THE CARS, THERERY Causing DEaToO—Tie Accused Fully Exculpated.—Yesterday afternoon a hearing was had at the jail in the case of James Dingley, driver of car No. 8, arrested on the charge of pushing the newsboy Frank Davis off the cars, therevy causing. his death, on Menday afternoon Iast, full particulars of which were given in the Siar of Tuesday last. Justices Thompson and Johnsom heard the case. Messrs. OC. H. Utermehie and J. H. Eradley, jr, appeared as counsel for the ac- cused. The case had excited much interest, and consequently there was a large crowd in uttendance, and among them a number of con- ductors on the city railroad. Mr. Gideon, president of the road, was also present, and expressed his determination to haye the case investigated thorcnghly. Gen. Geo. Stonervun (U.S. cavalry service) was first examined, and testified that he was stand- ing st the front coor of the carat the time of the accident, and bad a hand on either side of the coor. The car was full on the inside, and a number of passengers were standing upon the front platformand steps. At the crossing near Brown's Hotel five or six newsboys with papers on their arms came up to the front part of the car, and the driver told them to go to the rear, as the front of the car was crowded, and there Was uoroom. One of the boys, who appeared to Le the larger one of the party, crowded through and passed by witness into the car. The car then started slowly on, when a news- boy—but whether he was one of the first party or not witness could not eay—persisted in get- ting on in front. The driver, seeing the boy’s _dctermination to get on, turned and said some- Ying in u tone of caution. The horses con- tinued tomove, and the driver tarned toward them, and the boy, instead of getting aboard, cisappeared from the step, and witness heard or felt the wheels of the car go over something, und on looking back saw the poor, unfortunate bey writhing on the ground. Some of the pas- senpers got out, and a large crowd collected ground the boy atonce. At the time of the ac- cident there was &@ man on the steps between the boy and the driver. The boy had his right arm full of papers, and with the other hand he endeavored to seize the handle of the body of the car. Witness shonié-judge the boy’s foot slipped, and that he swung around under tae car. Wituees did not believe the boy ever ef- fected a ladgment upon the car. The car was just beginning.to move as the boy goton, and the driverepoke to the boy in tones of warning. Some man was standing between the bey and witness, Witness saw the boy fai and the car then jolted as though it had ran cver & stone on the track. Witness saw the criyer put the lines in his left hand and stretch out his right hand, but whether it was to save the Loy cr to push bim off, witness could not poeiively say. The boy was standing on the elep to the right of the driver, and had hold of the wires and was learning back, and he (de- cessec) might have been dizzy. It woulda have made witnees dizzy to have stood in that petition. When the driver spoke to the boy he uddseesed him in a very pleasant tone of voice, and there was no evidence of anger or irrita- tion. It the driver was angry, he would have spoken in a loud tone of voice. Did not see the driver tonch the boy, but only saw him extend bis right hand,and witness thinks it wae for the purpose of catching the deceased. 1f witnese hud been in the position of deceased, anditthe driver hed addressed in a similar tone, Le would have considered it a caution. Justice Thcmpson here asked Mr. Gideon (rrsident of the railroad) if there was not a regulation against passengers riding on the piatiorm, and if conductors and drivers were Lot required to prevent it. Mr. Gideon replied that such was the rega- lation of the railroad company, but it would require a regiment of eoldiers to enforce the tegulsticn. He (Mr. G.) had to scold the con- ductors every time he rode in the cars for this very thing. He asked the boy if he Was pushed off the car, and he re- plied “Yes.” The boy was then asked if it was the driver, and in a most decided and em- phsiic manner he said it was not. Witness was satisfied the boy was in a condition to give @ correct answer. Dr. W. A. Childe, surgeon of the 10th Ver- mont yolunteers, who was present when the accident occurred, and examined the condition cf the boy, corroborated the testimony given by Mr. Jewell as to the boy’s answers to Mr. J.s question. dir, Paul Kraft, of this city, who was on the frcent platform of the car at the time of the accident, testified that deceased was standing by his side, and he caw the driver pat ont his hund as if to rescue him. A moment after- wards the boy feli, and witness excisimed, “Ob, my God, the boy is killed.” The driver appeard interested, and said he hoped not. ‘Witness does not think the driver touched the boy when he reached ont hishand, The driver was in the act of extending his arm when the boy was falling. Josiah Langiey, who was also on the car, testi- fied that he saw the boy try to get up, and the driver said, “Lookout, sonny, you might fall there.” He saw no one push the boy off Copt. J. H. Reynolds testified to the amiable and humane character of Dingley, having known him as adjutant of the sth regiment Maine volurteers. In answer toa question, Mr. Charies E. Har- meee (Ge cflicer who so faithfully watched over the boy) stated that Mr. Gideon came to him and appeared much interested in the case, and tcld him (H.) to spare no pains or expense to have the boy properly cai for, and to have him properly buried ii he died, and that the railroad company would remunerate for all €xpenees, and would spare no efforts to bring any of their employees to justice who might be proven guilty of causing the boy’s death.
