ALLEN, WISE, AND (THES, CHARGED WITH RioT.—The ex- amination of the case of Aquilla R. Allen, John | Vi. Wise, James M. Busher, J. F. King, and Wallace Kirby,charged with a riot, and assault and battery on Caleb W. Mitchell, last week, cn the occasion of making a descent upon the how was held yesterday afternoon before Ferguson. The first witness called was Nelson Way “ho testified that he belonged to the squad which went to Mitchell's house, and that the | ad left the Guardhouse between eight and sine o'clock, under command of the orderly | sergeant of company I, 10th New Jersey. On the way they were joined by Messrs. Allen, Kirby and others. When they reached Mr. Mitchell's house, witness and two other soldiers went up stairs witk Mr. Allen, under whose orders he considered himself. They went in ene room and arrested a number of persons, who were handed down stairs, but witness did not see Mr. Mitchell in the same room. Mr. Allen went towards @ room in which Mr. Mitchell was, and kicked against the door. Witness does not know whether A. asked the door to be opened. Allen kicked the door oper, | and A. and the complainant took hold of each other. Allen turned Mitchell over to Witness, and he gave him over to two guards. Wise and Kirby were there. By the Detense.—There were thirty or thirty- fiye persons in the house when they entered. Witness went up stairs and found Al- en, who kicked at Mitchell's door. M. asked Witness who was kicking at his door, and w ness pointed to Allen. M.asked Allen by what authority he was kicking in his private room door. Mitchell afterwards came into the bar- room to wash his head, and A. said the house | had long been a fence, and he was determine 1 to break it up, and that M. was a coward. Allen did not show a warrant, but showed some | sort ofabadge. Witness did not recgllectseeing ‘Wise, but saw Kirby there. By Defence.—Witness, when he saw Allen kick the door, told him not to do it. Witness had never known what ke was arrested for, and never heardghat there was a descent to be made on the house. Witness had seen gaming apparatus in the house, but did not know that any persons were there gambling. He did not know that a faro bank was kept in the house. ‘There was a gaming room in the next house, and there was a door connecting it with Mit- chell’s house. The liquors were sent up from the bar to this room when ordered. Mr. Ranken, 3worn.— Witness lives next door to Mitchell’s, and was in the bar-room at the time of the descent. Allen and a small squad of soldiers went up stairs, and witness follow- edthemup. After they went into the gaming- room they went back through the hall. Wit ness heard a kick at a doer, and afierwards saw Mitchell and Allen clinched. Mitchell broke away, and the blood was running down trom his forehead. Witness heard some one say he had been struck. Allen said that he | was the man that he wanted, and called him either a s—n of a b—h or thief, and is not sure but that both names were used. Hammack, sworn.— Witness was sent tor en the night in question, and immediately went down, when he found Alien walking the floor in an excited manner. Witness owns the Park Hotel, occupied by Mr. Mitchell. Wit- nets found a sword across the door, but Mr. Allen gaye him permission io come in. The danguage used by Mr. Allen was too vulgar for repetition. Allen said the house was 4 fener, and that Mitchel! was a thief, forger, urgiar, maker and passer of counterfeit monry, and charged that the house was a receptacle of stolen goods. Allen said he had struck the s—n of a b—h, and would have shot him if he had his pistol. Allen closed up the building, and appeared to bein charge. Mitchell had kept bar for witness for five years.
