Thompson, Josiah R_ Starges, and —— Averill, in chancery, was brought up for investigation by the Court. In this sult action is brought {a chancery by Bigler, a judgment creditor of Pauper, to 4 Sethe a deed made z Thompson to Sturges for Meridia: Hill, awaluable real estate inthe county of Wash- ing on, District of Colombia. The deed from Thompson to Sturges recites that he had solid the property to Sturges for $100,000, and there is areceipt signed by Thompson and his wife at the foot of the deed certifying that Sturges had aid to them the said sum in fell. The deed to Sturges was executed on the 3ist day of October, and not recorded until the first day of July, when there were recorded three mortgages upou the property from Sturges to one “Averill to Seeure the sum of $65,000. which is now admitted to be the full amount of the purchase money. Averill admitted that he beld the bonds tor 965,000 as agent for Thompson, and has no in- terest therein, and that no part of the purchase money has been paid by Sturges. The plaintiff, Bigler, and otber judgment creditors of Thor son, who have come into the suit by petit! seek to set aside the deed to Sturges upon the round that it was made and contrived -between im and Thompson tu delay, binder, and de- fraud Thompson’s creditors in the recovery of their debts.
