We are persuaded that ¥arions cir- cumstances that must forte themselves on his knowledge ere the termination of that (the respite) will, as they should, redouble in this case the cautiouness with which he hasinvaria- bly interposed his exeentive power to stay the judgment of the law. The fact of the atrocity of the civoumstances of the crime for which the condemned man was sentenced; his notorious close association with the men who have now for so long murdered, burned and maimed in our midst, in too many cases without effective let or hindrance from the law ; the fact that no efforts have been sufficient to prevail on the court, jury and bar to unite in petitioning to 8 taside the sentence; and the prevailing senti- ment of the great mass of our fellow-citizens whose lives and property are at the mercy of desperadoes, in forcing themselves o1 the notice of President Buchanan, as they now ea,ely will, render it certain that ere interfering’ in his behalf, he will make assurance doubly su re that the demands of public justice and the be st in- terest of society here require that the !aw’s fullest penalty should not be exacted in tiiis case. Tae Pracs or Wasnixcton.—It is said that the new Mayor, if his recommendations in that connection to the Councils are accepted by them, designs appointing Mr. Justice Goddard to be tho head of the police. If that be true, the whole city, without distinction of party, will regard it as an earnest that the Mayor really intends lending all h's energies, not to reward the partizan for his election, but to re- store the rule of law and order over Washington city. Mr. Justice -or Captain—Goddard, (by which title he is better known.) as an executive police officer has the confidence, in an eminent degree, of all men of all parties in Washington. To the Councils we have a word to say in this connection. The opposition to the Mayor’s recommendation for an increase of the pulice force is almost universally condemned by the tax-payers of the Fedcral Metropolis. Their impression is, that it behooves the Mayor to rid the city of the States Hose, Rams, ct al , at any reasonable cost. They know well, that, under existing circumstances, that cannot be accomplished without some additional cost upon themselves, which they will pay cheerfully. They credit the Mayor with an earnestness of purpose in this matter which is worthy of all Wo hope that bis advice will pre then that he will not only make Captain God- dard Chief of the Police, but that he will tender to Captain James H. Birch the next position upon the forco, in order that he may thus ob- tain a guarantee, as it were, of the best efforts of almost all the entire party that opposed his election, to second his exertions in favor of the restoration of law and order among us. Captain Birch is notoriously not only a man of energy and integrity, but as intelligent as fearless aud untiring in the discharge of his duty asa policeman. of thiscommunity. If his services are enlisted on the police of Washington, the Mayor will have @ guarantee that no partizan influence can po - sibly be brought to bear against the success of his (the Mayor’s) efforts to rid the city of its ruf- fians. Itis due to Captain Birch that we should say that we have neither conversed or heard from him or any friend of his on this subject We use his name in this connection only because we know well its value in it, and are anxious the Mayor's exertions to restore peace and the rule of law and order in Washington shall be successful; as they cannot be unless the com- munity, without the distinction of party, have that confidence in them which the opposition cannot be expected to have, with the *ppoint- ment of an entirely partizan police at his han is. Arrican Emicration.—During the early part of April, Messrs. E Lafitte & Co., mer- chants of Charleston, 5. C., applied to Win. F. Coleock, Esq., Collector of Customs at that port, to clear the American ship Richard Cob- den, W. F. Black, master, for the coast of Af- rica for the purpose of bringing a cargo of “African emigrants’ to some port in the United States, not designated. The applica. tion was refused, and the collector wrote to Hon. Secretary Cobb for his opinion on the matter, under date of April 20. The Seeretary replied on the 22d of May, and his answer, not long since published, indicates a thorough re- search of the authorities in order to frame an opinion that will stand the test of law. Ile quotes the several acts of Congress of 1794, 1800, 1803, 1807, 1818, 1819, and 1520, to show tho illegality of importing persons of color for slaves, or to he Ae/d to se rvicc, and then refers especially to the act of Fobruary, 18033, the lan- guage of one clause of which explicitly pro- fahits the importation of persons of color, whether to he slaves or free, into any port of the United States, situated in any State whose local laws may prohibit the importation or im- migration of such persons into its territory. The Secretary then argues, that as all the Southern and most of the other States of the Union have local laws forbidding the introduc- tion of persons of color, bond ov: Sree, and as the port to which this vessel proposes to return is not named, the refusal to clear a vessel for such a purpose is legally justifiable This decision, he says, is further sustained by popular sentiment. is every portion of the country, as that sentiment is manifestly op- peed to the increase of the free negro popula- jon. The Secretary also maintains that it is within the province of Foderal officers to suspect the unlawful object of the parties applying, where acontemplated evasion or infraction of the law is so obvious as in this instance. It would be absurd, he continues, to believe that Messrs. Lafitte & Co., purpose bringing these African emigrants to this country out of motives ot philanthrophy alone, and whence, then, can they expect remuneration? If there are per- sons in Africa desirous of emigrating to the United States, of which not the slightest ground for belief exists, they have no means to pay for their transportation, and who is to defray the expense of their being brought hither? It is thus apparent that the intention is to bring these persons for the purpose of making them slaves, or binding them to service, and in the application to clear under pretence of bringing them as free and voluntary emigrants, there are palpable reasons to believe the parties applying intend an evasion of the laws. consideration of the statute provisions cited, and of this almost obvious attempt at evasion of law, the Secretary fully endorses the refusal of the Collector. Apropos:—tIt is rumored that the Kirkwoods are now to add half the remainder of the “‘Kirk- wood block,”’ on the Avenue and Twelfih stree’, to their so popular establishment, which bas been crowded to overflowing with guests ever since the opening of the session. - We trust that: it is so, for we have witnessed.more than onc of late the disappointment of strangers unable to obtain accommodations there, owing to the overflow of guests upon them. The National has already lived down the ter- rible recollection of the “hotel disease”’ of eigh- teen months ago. Since December last, it has gradually been gaining in theconfidence of the public, until, at the end of the session, its per- manent guests numbered perhaps six hundred —as many as ever before in its’ most popular days—statesmen, literati, speculators, belles, beaux, millionaires, adventurers, and sober steady fellows. The truth is, no other hotel was ever better kept in this country than thé National, in the hands of its present empres- sarios. Fortunately, there is business enough for them all. Browns’ has a run of eustom fairly inherited by its present proprietors, and earefully at- tended to by them, which has kept it full ever ince it ‘camo into the hands of its present pro- prietors, notwithstanding the additions made to it from time to time to meet the increasing demands upon the hotels of Washington. We are no beliover in the idea of a want of an additional hotel at the West End, because we know, that up to this time, the presont lead+ ing hotels of Washington have been increased in their capacities so as to afford comfortable accommodations for all visitors to the Fedoral Metropolis excopt in inauguration times, when from fifteen to twenty thousand persons pre- cipitate themselves upon us for from one day toa month. The idea of building hotels for the accommodation of that surge of travel for an average of a single fortnight once in evory four years,is a notion which no Washington city capitalist will adopt; for all of them havo cut their eye teeth, we take it for granted. Tas ATLANtic TeLeGRarH.—The Navy De- partment have advices from Capt. Hudson, in command of the U. S. steam frigate Niagara, dated Plymouth Sound, England, June 3d, inst. Capt. H. writes that the fleet to attempt a sec- ond time to lay the cable, (the Niagara, and the English war steamers Agamemnon, Valorous and Gorgon,) put to sea on the 29th May, and proceeded to latitude 47 dog. 12 min. N., longi- tude 9 deg. 32 min. W., where they commenced experimenting in 2,530 fathoms water. A por- tion of the wire was paid out and laid on the bottom, and the electricity was duly passed through the whole coil, about 3,000 miles in length. Mr. Everet’s machinery for lowering and heaving the cable wire, running it out, &c., gave satisfaction. The Niagara was to take on board 40 miles of new wire, and on the 10th instant, the squadron was to have left to begin the final work from tho centro of the great plateau. All were well on the Niagara at the date of Capt. Hudson's dispatch. Navau.—Tho Navy Department has news froin the steamers Fulton and Water Witch, at Cuba, and from the Colorado at St. Domingo. The captain of the Colorado represents Presi- dent Baez's situation as very critical, and affairs there as in a state of great disorganiza- tion. Peritiomx¢.—The efforts mado yesterday to save Powers from the expiation of his terrible crime, as sentenced by the court, were most remarkable. Never was a President of the United States so beset before in such a case, as Mr. Buchanan in said to have been.
