THE SOUTM PARK SENSATION- ‘Ti Trracxe published yesterday {n_ its Washington dispatches some Jnterestiag ada- 2s Hi#d in the Supreme Court in the case of Kerr vs. Phillips et aL—a Dill brought to settle the title to what {3 known as the Phillips tract, which will, whep con- demned, form a partof the South Park system. “This land bas been in litigation tor many years, has been the subject of endless bebate in the courts and in the newspapers, and it was not ex- pected that anything new. or auything starting nt least, could grow out of it, Some of those aflidavite, however, wero rather sensational, since they made serious charges'against leading attorneys of this city, alleging in substance that they had been derelict in their duty, and also retiected upon one of cho members of the South Park Board. The gist of Phillips’ aifl- davit, 60 farasit concerns Leaming & Tnomp- son, is that they were unfaithful to tho inter- ests of their client, Mrs. Puiilips, afiant’s mother, or, in other words, soid Ler out. JOSEP N. BARKER. 5 Mr. Joseph N. Barker said that Robert Rae end himself were employed by Charles H. Atsins and Mrs. Phillips to tw: adefense in the case of Kerr vs. fhe South Vark Commissioners and others. In s0 domg, they realized the necessity of fling the plea referred to by A 5 in his aftidayit, They prepared it, submiticd it to At- ins, explained and read it to him, and he signed it. The answer to the original bill was then pre- pared and submitted to Atkins, who deciined to gign the same, but authorized Barker and Kae, as his uttorness, to sign it, They did so, and it wss filed. As to the contract (filed of record in 1803) between Barker apd Rac on the one band, and s and Mrs. Phillips on the other, Mr. Bark id that was an entirely legitimate traneuction. Tho arrangement was made in remunerstion of legal services ren- dered and to be rendered. -\tkins ana Mrs. Phillips were without 2 solicitor, and employed Barker (with whom Hae was atterwards 3S+0- Ciated), the case having then been abandoned by all the attorneys who bud charge of that inter- est, No other solicitor bad appeared in the case on that side from that day to this. The fee of four-tentbs of the amount to be recovered was generally considercd os a reasonable one, in view of all the circumstances. There was no money to. be pail, but the attorneys were to receive 2 proportion of the amount to be recovered, in payment of which services ren- - dered and to be rendered they received the decd spoken of, neitner Mrs. Puillips nor Atkins hav- ang any cash meaus. Mr. Paul Cornell, whose name was mentioned in connection with the case, was seen, and fur- nisbed. the reporter with the following state- ment over his own signature: ‘To the Editor of Tne Chicago Tribune. Cnicaco, Nov. 12.—In reply to the statement in this morning's Trimet that Iwas interested with Leaming & Thompson in s contract in the Phillips, Kerr, or Dunleyy tract of land located in the South Bark, I desire to.state that I never had any interest of any kind, directly or indi- rectly, pertaining to any fund within the limits of the South Park with any: person whomsuever since my first appointment as South Purk Com- missioner, PAUL CORNELL. LEAMING & THOMPSON. Col. B.S. Thompson, on behalf of the firm of Leaming & Thompson, made tho tolowing state- ment: In 1868, a year before the passaze of the South Park act, a contract was inade between CB. Phillips, C. A. Atkins, and our firm, the object ‘ot which was to clear, if possible, the title to the premises in question trem the claim tu the same then made br Sir. Kerr. Phillips at that time eluiroed to have been divorced from Mrs. l’hil- lips, and refused to recoguize ber in. the tru action. Afterwerds, in the same yeur. @ con- tract was mde by Atkins with Mrs. Phillips, te object being to free the land from uny claim she might have of inchoate rictt of dower, and for that purpuse Atkins agreed to pzy ber $509 in cash, and to convey to her five acres of the land when he sbould succeed in securing the same. She afterwards claimed that she should have ten acres, and a second contract was made with her futher, Mr. Wright, of Cincinnati, Jan. 2, 1869, changing the lurmercontract ¢o as to make it ten, instead of tive, neres. Neither our tirm nor xuy member of it ever acted 2§ the attorney of Mrs. Phillips. She pro- fessed to be acting under the advice of Judge ‘Tilden, of Cincinnati. 1u isis we. procured the opening of a judgment in ejectment azaiust one Burton, which was another mune for C. B. Phil- lips; and in 1863, when Mr. Kerr's attorneys moved to set uside the order opening sald judg- ment, we formully withcrew our appearauce ia ‘the case 28 attorneys in open court, having be- fore then obtained from Mr. Phillips written permission to do sv. We tten ces: anything further to do with the ca: neys, both Atkins and Phillips employing other attorneys; nor bave we since bad anything fur- ther to.do with ft until last sprmg or summer, when we learned that Mr. Rae, whom we under- stood to have been engaged by and to be act- ing for Mr. Atkins, had commeuced a suit aguinst ~Atkins, s¢ rng up that Atkins was solely a nuked trustee for Mrs. Phillips. on tue ground of certain written declarations which Rae bad procured from Atkins while Rae was ostensibly employed py Atkins 23 his solicitor, and which Atkins claims were improperly ob- tained and unwillingly made by him at tho dic- tation of his solicitor, and without underetand- ing the nature of the papers execured by him. At the solicitation of Atkins, his alfidavit, tiled in the Supreme Court at Washington, wus writ- ten and sent forward, 1} will add that the con- tract which wus attempted to be made between Kerr and the South Park Commission would in no way interfere with auy righls which Mrs. Phillips, or any one else, might have in the prop- erty. RUSSELL’S REMINISCENCES. ‘The reporter also called upon Mr. Sartin Rus- ‘ell, at presents member of the South Park Board, and asked him what information he sould give in regard to the case. Mr. Russell said he became 2 member of the poard in: 3larch, 1890, and, upon entering upon his duties, had been informed that a contract had been prepared with Judge Dunlevy, Kerr's attorney, forasettlement of the case, but the Commissioners had not ratified this contract. Mr. Morgan, who was President of the board at the time, had expended park money to the amount of some £90,000, and Mr, Russell intro- duced a resoluton, which wus passed, asking Mr.. Morgan to submit to the board an itemized report of his expendi- tures, uceompanied by the vouchers. Mr. Mor- gan bad neglected to do this, but be submitted tothe board certain papers and notes. from which it appeared that he bad endeavored to parebase for the commission the undivided fourth of the tract conreyed some years before to Mrs. Dobbing by Kerr. Itappearéd that ste had made a deed of this undivided interest toa. trustee who was'at the time a clerk in the ottice ot R.S. Thompsou—then attorney tor the buard —but the trustee failed to state for whum he was holding the title thea conveyed to him, and made no conveyance to the commission, though he bad been requested to do £0. Lesides ex- pending this $%,0W, Mr. Russell said, Morgan bad used other money to take up notes, together with their interest. which had been’ given by Debbing for the deferred payments upon Kerr's purchase. The papers and notes submitted to the board by Mr. Morgan were referred to Messrs, Russelt and Bontield, as the Morgan transaction was considered vague and unsatisfactory. They de- cided to tile a bill in chancery, to secure tha in- terest of the commission in the expenditure, and that case was now pending in the United States Court, The case was further looked into by Messrs. Walsh, Sherman, Bonfield, and Rus- ecil, and, in view of Judge Hurhin's decree of cizhty acres to Mrs. Phillips tor aer homestead, they resolved to avide by the decision of the United States Court and not force a setticment. ‘The position which the ccummission had assumed toward the litigation, from the first, eave the contract with Phillips for the tract at SSW) per aere, was also taken into consiacration in this pores ae complicated condition of the Judze Dunityy had asked the commission to execute thé contract with his client, Kerr, and Mr. Bonfield. had died just before the case was ready for trial. Mr. 31. W. Fuller, who bad been connected with it before Judge Harlan’s de- cigion, was then retained by the board. _Mr. Russell said he did not know of any of the carly intricues of the cuse, except from hearsay, and could not say whose claim wus the best. Phillips, who bad some business transuctions with aman named Kerr, of Ohio, whicn wero. uot satisfactory to either party. Kerr su ed Phillips and got judgment, and upon this execution bought in the tract, taking a Sheritt’s deed for it: These proceedings all ante- dated the location of the purks, and wuen they @ located the tract wus included. Judge Heckwith was acting as the attorney of the Commissioners at the time, and made a con- tract with Phillips to purenase the lund for park es ut $300 per acre. Upon hearing of Kerr filed a-biil in the United States Court, asking. that. the Commissioners be enjoined from baying any money to Phillips for the land, and that the cloud on bis title might be re- taoved. ‘The family reiations between Phillips and his wife bad not been amicable up to this time, and in Ipd2 their home on the tract was destroyed by tire. After that Phillips abandoned it. During these years there were a number of transfers with réference to the tract, but Mrs. Phillips set up that she was the owner of it in fee, having had transfers from Phillips justifying ber claim, and ulso the savior of the homestead, and she claimed that the Sheriff's sale was defective, in that It had not set aside her homestead, as re- qured by the Iltinois statute. Phillips himself nis demanded the homestead. and claimed that ris proceedings under which he bad ob- tained the judgment were fraudulent. Jn J8y8 the ease reached a hearing before Judge Harlan, who first decided that Mrs. Phillips was the savior of the homestead, and es were set off toher. KEENAN IS HAPPY. Judge Dickey Grants Him a Super- sedeas. Keenan, the condemned raurderer of Henstey, was all emiles yesterday in consequence of Judge Dickey’s action in granting him a super- sedcas, and when seen by a ‘TRIBUNE reporter, whe visited him in his cell, wus in a bappy rev- erie, with his beeis above bis head and resting them upon the bars of hiscell. His attorney -. Storck, visited bim during the day, ana had given bim to understand that he would leave tuwn this evening tor Mt, Vernon, there to press his clams upon the Judges’ ot’ the Supreme Court. In response to ao inquiry Kee- nan smiled, and. said that be must of course conics 10 feeling a great deal better than he did tho day before, although he felt rensonably certain that be would be granted at least 2 stay of proceedings. * Do you Hope to get otf ultogether now?" “No, indeed,” was bis prompt reply, “that would'be going too fur, But ido expect to set an stipersedeas, and consequently a new trial.” He was congratulated on bis good fortune during the day by a great number of ‘the visit~ org who were at the jail yesterday. Mr. Keenan hus quite a time ‘to live yet, as bis ease may not be disposed of until some ‘time after the session opens. ‘Tomorrow Mr, Storck will go to Mount Vernon togetthe writ of error referred to in Judge Dickey's order, and on his return it will be placed in the hands of tho Skerift. giving him oficial notice of the court's order. Mr. Storck RELIES ON THE POINT that the evidence in the case is purely cireum- stantial, and that the conviction was secured on the evidence of an interested pxrty who was not corroporated. It will be claimed that Keenan was arrested some time after the murder for participation in the Piltinger burgiary, and that he served a sentence of one year in the peni- tentiury for that crime after having pleaded guity.. While ie was in prison, it was further cinimed that the police entered tnto an arran:e- ment with Haberkore, the principal witness tor the prosecution, by waich the latter was to es- cape punishment for complicity in several burglaries which he bad committed with Kee- nan, provided he would secure the conviction of Keecan forthe Hensley murder. The counsel Tor the defense desire it clearly understood that they make no accusations or charges against State’s-Attorney Mills or his office. They bold solely the police responsille for Haberkorn’s action. The counsel also puintto the fact that no persons could, or even attempted to, recor nize the man who tired the shot that killed Mr. Hensley, Mr, Storck feels confident that he will secure new trial, wheu he will attempt to de- molish Haberkorn’s evidence. —— HYDE PARK.
