Mr. Edmunds insisted that the Valetine scrip case was in the Courts, and. that the Constitution of the United States did not give the Senate the* power to decide the cases He claimed, moreover, that his amendment would protect the rights,‘if any, of ndverse claimants, including the-abutting ownners and the rival railroad “com- panies, as well® as the Valentine scrip claimants. In accordance with this theory he moved the following amend- ment, which. be said, was customary in ali bills of .such character—viz.: “Nor shall this act affect any valid and legal ad- ‘verse private ‘right” Later on, Edmunds proposed to add, if desired, the- historical - words, “ if any.” Upon this amendment THE ONLY DEBATE - upon tho bilt proceeded, as, after it was dis- posed of, the bill was passed viva voce, Mr. Edmunds alone voting in thenegative. Judge Davis, with an indiznation which Chicagb ‘people will weil understand, sald:- ** Ido not Want Congress to recognize any of tiis Val- entine scrip business. - It is too 'bad,—the ° idea that Congress ever intended that Valen- tine, a California speculator, should get this land 1 i L B . He also ‘denounced the Valentinescrip claim-
