Hicld aud Dixon, the only witnosses in this caso, bad not been in Dowling’s house during this’ timo, and be was consequently dis- charged. ‘The jury in this case wag ablo to agree, finding no difficulty in returning a verdict of ‘nob guilty," and John went his way rojoicing. Tho cage waa oponed by the contest going back to the Twenticth Ward, First Procinct. ‘Tho object of tho move wan said to bo to givo the ward all the discredit possible, with the hope of baving ita vote thrown ont by Congress, which would secure Mr. Le Moyne'’s election, The first witness called was JAMES GNUEN,' on the part of the contostant: He testiflod that ho resided at No, 120 Illinois etroet at tho tino of the oloction, and was 8 legal voter in tho Tirst Precinct of tho Twentieth Ward, oe attempted to vote for contestant, but tho jndges refused to take his ballot, saying bis namo had already been voted. IIo knew one Janica Scully who bad lived at the same place, aud sho voted at tho election, although bo had beon dead over a year. No such parties as James Ticket, G. F. Swartz, Albort Bwartz, Louis Green, Vat Mack, Join O'Brien, H. Sniderly, J. Barrott, or J. S. Fito- hill resided at the houses, A man by the name of W. I. Hickman had resided there, but at tho time of tho election Le was living in tho iret Ward. Cross-eramined—Io was not registored in tho First Precinct of tho Twentieth Ward, and when offering to voto did not present an allidavit that ho was a resident and legal voter of the ward. Tho ples in abaroment to the jurisdiction of tho County Court in the case of Walsh ve, Gun- derson—napirants for the Aldermanship of tho Eleventh Ward—was to hava been filed yeator- day, but, owing to tho absence from the city of Leonard Swart, counsel for Mr. Gunderson, an application was mado by Mr, Burvy, aasociato counsel, for a continuance, Mr. Burry stated that Mr. Swott waa in Yank- ton, Wyo. 'T., and he desired a little further time in which to plond. Mr. Knickerbocker, for Wateh, &aid that coun- sel had intimated that a pleain abatement to tho “jurivdiotion of the Court was to be tiled; tho Preparation of the ploa was » amall matter ; and it seemed to Lim it should be filed in accordance with tho order of the Court.
