NEW HEARINC IS HELD PROBABLE IN LAVOYE CASE: Motion for Reopening of Dispute Involv- ing Moving Entire Town Filed With Interior Department It is now probable that anotlrer hearing will be grant- ed in the townsite case of Lavoye, according to Floyd E. Pendell, attorney for Louis P. Lavoye, who has just re- turned from Washington, D. where he placed a motion with the secretary of the interior for a rehearing. Less than a month ago Hubert Work, interior depart- pesca a Av Nagata ac ment head, decided the dispute in,- a = -“West Point favor of the Ohio Of] company which aa has contested Lavoye’s application for a patent to his homestead on the kind might be brought against the secretary of the interior. Both of these re] are emphatically de nied by Mr, Pendell. As to the first statement, the defendant's et- torney declares that had such action been taken he would have been the first to have been informed; and as to the second point, he has in his files supreme court decisions of an opposite nature. It seems*that the department fs ready to arrange @ reconsideration of the townsite case, since ft did not hesitate to entertain a motton for h hearing when asked by Mr. Pendell. Besides this motion, the Casper lawyer has requested of the secretary a_complete presentation of all pertinent and basic facts in the contest by both sides before the reg« istrar of the federal land office in Douglas, If granted, this prelim. inary action will take place in the near future. In event no satisfactory settlement can be obtained from the department of the interior the final appeal be- fore the supreme court will be taken. In other words, Lavoye will stay on the map for some time to come, according to the town own- er’s attorney. His political opponents for years had attacked him for accepting a pension of $6,000 a year for his long public service, and even some of his friends wondered at it. At 21 Lord Chaplin inherited an estate whose yearly revenues were $200,000. ‘When his famous Hermit won the Terby in 1867, Lord Chaplin collect- ed about $500,000—real money—tn bets. Hermit for years afterward earned him $75,000 a year at stud. In a speech shortly before his death, Lord Chaplin stated that his stud farm had brought him $60,000 @ year for twenty-five years. Lord Chaplin's will disclosed that he left less than $25,000. He had been living on his pension—about one-fiftieth of his former income, Tt was found that his huge estate had become a liability instead of an asset. During bad farming times he had always granted tenants’ re- quests for reduction of rent, and yeariround, Marks Worth More! sewn" oOe ha eee eee es left to servants.
