At this time the Board examined and approved Vouchers No. 7819 to 7847, inclusive, submitted by the Bur- leigh County Welfare Board, and or- dered warrants drawn for same. Commissioner apierase moved the adoption of the following motion: P RESOLUTION Be Is Resolved, That Sections 3 and 21 of that certain ORDINANCE REGU- LATING THE SALE AT RETAIL OF INTOXICATING LIQUOR WITHIN THE COUNTY OF BURLEIGH, NORTH DAKOTA, etc., which ordi- nance was passed and adopted by this Board of County Commissioners on December 3rd, 1936, be and here- by are amended and re-enacted to read as follows: “Section 8. LICENSES TO BE I8- SUED HEREUNDER. Licenses to be issued hereunder shall be of two nds, as follaws, to-wit: Whole- saler's and retailer's licenses. i The license fee for a wholesaler’s license shall be the sum of Five Hun- red Dollars for a six-month period as hereinafter provided, payable in cash, Retailer's licenses shall consist of On-sale licenses the Bi two kinds, to-wit: and off-sale licenres. The license fee for a gale license shall be the sum of 0) Hundred Dollars for six-month period (as hereinafter provided), pay- able in cash. 5 ‘The license fee for a retailer's off- sale license shall be the sum of One Hundred Dollars for a six-month per- jod (as hereinafter provided), payable in cash, unless the place licensed shall be within eight miles of any incor- porated city or village, in which case the license fee shall be the same Aas charged by the nearest city or village within said eight mile radius. Any leensee holding an on-sale license shall be allowed to retail off- sale without the payment of any ad ditional license fee, All license fees shall be payable semi-annually in advance at the time of the issuance of license, on the first day of January and the first day of July in each and every year; provided, however, that any person now possess- ing an annual license, and who has paid the sum of $200, therefor, in ac- cordance with the provisions of the existing ORDINANCE of this County, need not secure another license under the provisions hereof, until the ex- piration of such person's present li- Cense on June 80th, 1938." 5 “Section 21, TERMINATION AND REVOCATION OF LICEN! Tho licenses provided for in this resolution shall terminate on the 30th day of June, and/or the 31st day of Decem= ber in each and every year next fol- lowing the date of issuance, except as herein otherwise provided, or such shorter term as may arise by reason of the revocation of such license or licenses for cause which shall include among other grounds, the following: (a) The death of the licensee. . (b) When the Hcensee ceases do- ing business at the location licensed and @ permit for change of location has been denied. bi (c) When the licensee be adjudged ankrupt. (a) When the licensee be convicted of committing a felony or any other offense involving moral turpitude un- der the laws of the United St under the laws of any of the Sti 5 (e) When the licensee ceases to he a legal bona fide resident and citizen of the State of North Dakota. (ft), When the license or permit of the licensee from the United States Government to sell intoxicating Nquor has been terminated or revoked. (g) When the business of the li- censee at the location licensed shall be conducted in violation of health or sanitary regulations or other ord- inances, (h) When the licensee has made any false statement in his application for license. When any Ncense is terminated or revoked for cause, or the licensee vol- untarily ceases business, no part or portion of the license fee previously paid to Burleigh County shall be re- urned to the licensee or to th claiming under him. Any license issued under this lution may be revoked at any tim the County Commis: 3 of Bur- leigh County for cause; their decision as to what shall constitute sufficient cause shall be final, subject only to review by the Courts of this State. Upon revocation of any license, e County Auditor shall forthwith cause written notice of such revocation to be served upon the licensee within ten days in the manner provided by law for the service of a summons.
