TUESDAY, NOVEMBER 23, 1937 By KERMIT McFARLAND + (NEA Service Special Correspondent) Pittsburgh, Pa., Nov. 23.—Beginning Dec, 1, Pennsylvania will attempt to enforce a law limiting the work week of all employes to 44 hours. Pennsylvania is the first state in the land to undertake such legisla- tion. As an experimental preliminary to this law, the state has been attempi- ing to enforce, since Sept. 1, a 44- hour law for employed women. Part and climax of the most com- prehensive program of labor legisla- tion ever even considered at Harris- burg, the general 44-hour law was en- acted toward the end of the last ses- sion of the legislature, which ad- journed in June. Plans Wide Latitude The law specifically impowers the department to grant exemptions in any case where it believes the 44-hour limit will “work a hardship” on any business or industry. While no final rulings have been issued and copies of the law have not yet been made available for general distribution, the department has made it plain that it intends to per- mit wide latitude in compliance with the law. Virtually everyone who makes $25 & week or more will be exempted, it is expected. A court test, it is feared, might in- velidate the law as unconstitutional on the ground it is an undue delega- tion of power by the legislature to an administrative department. Believe It Unenforceable Employers generally have indicated they will make at least a show of at- tempting to comply with the law. Most of them assert they believe it unenforceable except under extreme- ly wide interpretations by the depart- ment, There is nothing in the act to pre- vent employers from cutting the wages of employes in proportion to the teduction in their hours of work. Almost every branch of industry and business in Pennsylvania has filed, o. intends to file, applications with the department for special exemptions from the 44-hour work week. Judged by the department's rulings or the women’s law, most of those requests will be granted. The law permits an 8-hour day, five and a half days a week, and provides certain restrictions as to lunch pe- rods and limits within which the eight hours must be worked. But all tnese provisions are subject to de- pertmental modification.
