Wheat of the Dis- trict of Columbia supreme court Fri- day upheld the constitutionality of the Public Works administration's | $200,000,000 power program in dismis- |, sing an injunction suit against 10 municipal electric projects in four states. Wheat ruled on three major legal Questions in his lengthy opinion. He held that the plaintiffs, the Alabama Power company, the Texas Utilities company, the Oklahoma Util- ities company, and the Iowa Light and Power company, had a right to bring} suit to question the validity of the Power projects. He ruled, however, that the two statutes under which the projects are carried out, the national industrial recovery act and the emergency relief act of 1935, are constitutional. He also held that the power pro- Jects were authorized by the terms of these two statutes. The United States court of appeals | for the District of Columbia recently | held the resettlement administration, created under the 1935 emergency re- lief act, unconstitutional. Another case challenging the con- stitutionality of the PWA power pro-/ gram already is before the supreme court on an appeal by the Duke Power company from a circuit court ruling upholding a grant to the Buzzards Roost Power project in South Caro- lina. To Use Court Room It is planned to make use of the federal court room in the postoffice as a certification station and possibly as a general delivery point where the veterans, who may be missed in the first delivery, may get the bonds. H. E. Schriver, Fargo postal in- spector, had charge of the meeting here Thursday during which he de- scribed in detail the method of de- livery to be followed by the post- masters. The bonds will be in $50 denom- inations, accompanied by checks for varying amounts. When the identifi- cation and certifying bureau has been set up in the federal court room, reg- ularly designated postal employes will |be stationed there to certify:the bonds for payment. After proper identification the vet- erans may turn in the bonds for pay- ment by getting them certified by the postal authorities. The bonds will then be sent to Fargo, which has been designated as the only paying point in North Dakota, whére checks j will be written at once and mailed out to the veterans’ address the following day.
