FRIDAY, DECEMBER 14, 1928 DEATH CHEATS «* NORTH DAKOTA MAN'S FRIENDS Federal Pardon Plea Denial Ar- rives Simultaneously With Death Note Fargo, N. D., Dec. 14.—(AP)— Death has cheated the federal gov- ernment and a group of North Da- kotans who made a plea to the fed- al board for William H. Wright’s ‘reedom following his plea of guilty to embezzling $600 in federal funds while deputy custom collector at 4, Northgate, N. D. # Seth Richardson, Fargo, United States federal district attorney, re- ceived two letters yesterday. The first was from the federal pardon board, denying a plea which had been made in his behalf by residents of Northgate and which had Richard- son’s support. The second letter was from the state’s attorney at Bowbells, inform- ing Richardson that Wright had died a few days ago as t > result of com- plications following an appendicitis operation. When arraigned in fed- eral court in Minot last month Wright readily admitted that he withheld funds collected as duties of grain imports into the United States while he was in the customs service at Northgate. He gave no explana- tion for his pte) however. Friends in Northgate and vicin- ity pointed out that Wright had asked for a tr_nsfer to the south in en effort to aid the health of his wife, who was suffering from tu- berculosis, and his infant child, who was suffering from heart disease. They expressed the belief that the funds which he had taken were used supplying the medical needs of his family and immediately began peti- tions and sent letters to federal auth- orities seeking to gain his freedom. He was released on bonds and sen- tence was withheld until a plea to eat at Washington could be made. Joseph Volk Faces Count of Breaking Bird Hunting Laws Joseph Volk, Bismarck, today faces a charge of hunting on a game reserve. He was arrested about three miles east of the city by O. W. Roberts, special game warden official, and brought to Bismarck, where he will have a hearing at 2 p. m. today. Antone Beer, justice of the peace, will conduct the preliminary hearing. Negro Gets Suspended 30-Day Sentence Here P. J. Perkins, Bismarck negro convicted yesterday of assault and battery, was given a suspended sen- tence of 30 days in the county jail by Judge James A. Coffey in dis- trict court this morning. The jury, going out at 11:15 a. m. and reporting to the court at 4:45 Pp. m., recommended leniency. Perkins was indicted on a charge of assault and battery with a dan- gerous weapon by the grand jury. The indictment came following a fight which took place between Perkins and S. E. Hilliard, Fort Lin- coln soldier, at a rural dance hall. about the legs in the encounter which kept him in the fort hospital several days. Perkins pleaded that he used the knife in self defense. Miss Valerie Cox, Minneapolis vio- linist_ who surrendered to authori- ties “to clear her name,” was ac- quitted of first degree murder charges growing out of the death of Elmer Olson, Minneapolis song writer, in circuit court here today. The defense rested its case Thurs- day afternoon without calling a single witness. Olson received a wound in the abdomen during a cottage party, near here, July 18, and died the fol- lowing day.
