Pratt, the Texan, either on the part of Fudge MecCunn oF of the United States authorities, though preparations were made on both sides with o view to possibie contingencies, Marshal Barlow, before the departure of President Grant, obtained from him an autograph order for 1» detachment of She First Artillery for his protection frow arrest by Fudge McC the latter had the warrant and other necessary papers prepared and ready for sie- avure, and Sheriff O'Brien had his deputies in readi- ness either to arrest Barlow or produce Pratt, as they might be commanded. At an early hour the soldiers arrived at the build. Ing in Chambers street containing the United States Court rooms and the offices of the Federal officials, took up their quarters in the United States Grand Jary room, ready st « moment's waroing to Fescue the Marshal from the clutches of the Sheriff ‘Bud his posse, should they present themselves. Judge McCann took his seat on the bench in the Bpecial Term of the Superior Court at 12 o'clock, and soon afterward United States District Attorney Pierrepont entered. Then the two had a brief co ference in the Judge's private room. The interview resulted in an understanding that Pratt should be Produced on Monday, Judge MeCunn agreeing that 1n the mean time he would not grant a warrant for the arrest of Marshal Barlow, ‘Tue Judge, on being informed by the District At (orney that President Grant had given an autograph order for soldiers to protect Marshal Barlow, re- plied that the Marshal would be under the necessity Of keeping the First Artillery about his person dur- Ang his whole term of oMce; that soover or later he ‘would havo either Barlow or the prisoner Pratt, Judge McCunn has received an avalanche of let- ters approving his action, All this fuss is about the arrest of John H, Pratt, the leader of the rebel gang that, in October last, overpowed the United States forces and murdered a number of unoffending Unionists inthe rebel town of Jefferson, Texas, Marshal Barlow says that Pratt was arrested by him under a warrant from ‘United States Commissioner Osborn, who is, by law, B Judge in regard to the arrest and detention of United States prisoners. Judge McCunn, the Mor. Bhal asserts, has undertaken to discharge Pratt on a writ of Aabeas corpus, and the Marshal maintains Lhat the case i# not a question of conflict between eivil and military authority, because the prisoner is held by him under @ writ from a Court of the United Bates, Neither has the case, in the Marshal's opin fon, any connection with the Reconstruction acts, A is simply a question whether the State Courts can Jnterfere with the writs and proceedings of a United Blates Court, and this point the Marshal considers pettled by the judgment of the United States Su Prevae Court in 1358, In the case of Abeiman vaainst Booth, when it was decled that a State Court bad no such power of interference with a United States process.
