Wo Re. 104 woman who was injured by e« oar of the Becond avenue Railroad company, brought an ection for damages, It appeared upon the trial that, in crossing the road, her foot tripped on the rail of the track, whereupon she fell, and « car ran upon her, causing severe injury. The Court awarded the woman damages to the extent of three thousand dollars, and in delivering the decimon, the Judge gave an expliot opinion respecting the genera! rights of petesirisns and the drivers of vebicles respectively, He held thet the right to travel upon « street or highway is common to all—pedestrians and drivers alike—the former having the right to walk, aud the laner © ewploy horses upon them, The Judge said that ase matter of law, ‘it is as much the duty of the vebicle to keep out of the way of the passengers, ae it ts for the latter to escape being run over by the former.” Therefore drivers have wo right to monopolize the privileges of the streets as they now do, and foot passengers should make them understand that fect by «lew legal oxpe- riences, Street cars, particularly, are s great nul- sance in this respeet, ae in every other ; and since the railroad companies can be impressed only through their pockets, we hope that they will be taught « few practical lessons such as that received 1p the case referred to. ‘The records of the land offices show that the an- nual sales of puliic lands in the Bistes are bt Nttle mors then sufficient to pay land office ex penses, and hence the Government revenue from Geis pource is next to nothing. Buteven if these bands were much more valuable to the Govern- ment than they are, we should sti) favor thelr de mation as homesteads. For this reason: Divided into homestead farms, and offered wo every man who would eccupy and improve them, ali the produc- five land would soem be settled, the producing capacity of the country would be enlarged, and fhe national wealih would be incressed sad aug- mented, These advantages would more than Dalance all the benefits accruing to the government from each sales, end in addition would greatly ex- pedite the development of the new States. There- fore, we hope thas Congress will pass» bill provid- tng for homesteads in the Biates, not sectional in Character, as is that © which we have alluded, hut @o grmeral that its advantages will not be withheld from the white people of the North. New York Legislature. Tan Legislature has thus far been occupied chiefly in preparations for the active duties of leg- talation. The sianding committees of the Assem- Dy were not announced unti! yesterday, and of course none of the bills thus far roporied have been considered. The only measure of special eonsequence to this city, that has been developed tn detail, is the proposition to establish a Sanitary Commission, which ts designod to have complete end exclusive control of all matters pertaining to the public health. The bill provides for the ap- peintment of four competent physicians, upon whom shall be conferred power to compel the sbeorvence of al) regulations that they may think edvisable for the health of the city, (he details of the plan are similar to Boose upon which the Police Department $s organized, and tt is claimed by the friends of the measure that the proposed commission would be wo lees wuccessful than the one alter which itis modeled. The pressure in favor of the Sanitary Commission is very strong, and the probability is Ghat 4 will be the next in the series of measures for making New York a tail to the Albany kite, Ib ‘will be three or four days before any important business can be transacted by the Assembly, as it Will take that long for the committees to examine the bills already referred io them. But as 1 am pow w ae free country, Ican fluier my wings, and can sead to my friends the truth of things as they exist there, without being afraid. In in first place, old men of 70 marry girls of 14 years of age, auc in some instances they give the te of ‘we child « cow, or en old gun, or some other trifling thing.
