VIETOR WINS POINT IN CHARGE HE STOLE CHILDREN'S LOVE Millionaire Accused by Widow Not to Be Examined in Westchester County, Carl Victor, millionaife resident of No. 907 Fifth Avenue, and his wife, Mrs. Ernestine Vietor, won a point this, morning in the legal battle by Mrs. Mabel Gunther of Orange, N. J., to have them examined before trial of her action for $200,000 damages for alienation of affections of her two chit- dren. Supreme Court Justice Mor- schauser at White Plains vacated the examining order. It was the contention of counsel for the Victor's that although they had a yountry estate called Karlsrhye on Clinto ‘Avenue, Irvington-on-the- Hudson, their bonafide residence was in Manhattan, Mr. Vietor, who Is seventy-nine, produced an affidavit that he is a taxpayer and voter in New York City and therefore could not legally be examined in Westches- ter County, Justice Morschauser up- held, his contention. Mrs. Gunther in her complaint al- leged that in 1917 the Vietors con- spired to alienate the affections of her thirteen-year-old son, Charles, and her fifteen-year-old daughter, Henrietta, and that the children have been with the defendants ever since. ‘The papers filed to-day claim the plaintiff has evidence that the Vie- tors will sail for Germany to-morrow and intend to remain there. Mrs, Gunther claims that they are going to take her two children with them. The Vietors in a counter affidavit say they are going to Europe only on a Visit and will return in September. WASHINGTON, April 14.—Hun- dreds of thousands of dollars are ac- cruing in the War Risk Insurance Bureau: because of refusal of bene- ficiaries to take Insurance payments, it was learned to-day. The parents of Thomas Speaks, Jennings, N. C., have refused to re- ceive Governthent insurance of their son killed in France because of their religious beliefs.
