Rowe has a resolution submit to-day ousting August Clueasens, the Socialist, who was declured elected to the Assembly last night over Murray Felenstein, Democrat, from the 17th District, New York City, as soon as Claessens attempts to take his seat. Claessens was one of the five So- clalists fired out of the Assembly after a long and expensive hearing by the Judiciary Committee at the session of 1920, Last year he deter- mined to make the run again, but Felenstein was declared clected. | Claessens contested the count und so much was uncovered that the Judici- ary Committee found the Socialist had been elected by a majority of 453 votes. Mr. Rowe, Chairman of the Judict- ary Committee, said the comimittee could do nothing else than unseat Velenstein, “But we don't have to seat Claes~ sens,"’ he said. “I do not think that there is amy doubt my resolution would have been passed last night, man who has not a seat, Claessens has to take the oath of office before the Secretary of State, having been declared elected by the Assembly, af- ter which he takes the seat vacated by Felenstein.
