The attempt of the Consolidated Gas Company to have the 80-Cent Gas Law, passed by the Legislature in 1906, annulled as egal and vold by a court order was argued before Judge Mayer in the United States District Court to-day. The argument was on a motion by District Attorney Swann to dismiss the bill of complaint. The District Attorney, Attorney General of the State and the Public Service Commission of this district wre the defendants, Judge William L. Ransom, former counsel of the Public Service Commission, and now a law partner of former Gov. Whitman, ap- |pany asserts that the 80-cent rate Is confiseatory. On behalf of the Borough of Man- hattan the District Attorney set forth that the st ents in support of the claim are general in character and are based on conclusions. No figures setting forth the earnings of the company since 1906, dividends paid, properties boughi—ae allewed—depre- clation and other vital factors are given tn the bill of camplaint it was said.
