Teatimony before the Magistrate showed that while the defendant was standing with his cab at Broadway and Forty-second Street an inspector of licenses got into it and ordered Horowitz to follow an automobile which was proceeding at a high rate of speed. The inspector testified that the machine he desired to follow was displaying a fraudulent license plate. While in pursuit of the taxicab Horo- wits was arrested for violation of the apeed laws. In hia decision Judge Nott says that both the Corporation Counsel and the Diserict Attorney consented to & reversal of the judgement on the ground that a statute should be rea- eonably construed, and that in cases which may be within the letter of the statute but are clearly repugnant to its spirit, Mablitty should not be en- forced. In other words, Judge Nott said, if a private citizen should see @ murder committed upon the high- way in his automobile and exceeded the speed limit in an attempt to ar- rest the murderer; or if he should ex- ceed the speed limit in conveying a seriously injured person to a hospital in an effort to save life, the statute has not been violated within the con- struction of it laid down by the Court of Appeals.
