Lyons, lender of the Thirty- first Assembly District, in a state- ment to-day charges Samuel Marx, the Democratic lender, with attempt- ing to confues independent voters by sending them a ballot marked for the Democratic candidates, with a state- mont that it can be used as tho offi- etal ballot in case of emergency, In support of his statement Leader Lyons has offered to give $1,000 to charity if the ballot sent out by Marx ean be used under any conditions. ‘The ballot alleged to have been sent out by Mr. Marx contains the follow- ing notice: “On election Day the ballot clerk will hand every voter his official bal- lots, properly folded. Preserve this ballot, as in case of the loss of the Official ballot this ballot will be re- ceived by the inspectors of election.” The only names appearing on the ballot which, {t is stated, may be ured as official in case of emergency, are the names of the Democratic candidates, and opposite each is a printed “X."
