Judge’ Pritchard sald he would not rule on this point until after the evidence was in. } paired by er DRIGGS FINED $10,000 IN A ROW ROW ACMI] AND GETS A DAY IN JAIL Nthis Time Fedsent: Hammond, Postal Fraud Conviction Bars Ex-Congressman| from Ever Again Holding Office Unner Federa Edmund H, Driggs, former Democratic Congressman from Brooklyn, who was convicted last week of having used his official position to advance the sale of automatic cashier machines to the Post- Office Department, was to-day fined $10,000 and sentenced to one day's im- prisonment in Raymond Street Jall by Judge Thomas in the United States Cir- euit Court in Brooklyn Drigge, who was very much affected by his position, had to stand and listen to a long address by the Court before sentence was imposed. As soon as he learned his fate his counsel handed a certified check for $10,000 to the clerk of the court and Driggs, accompanied by a United States marshal, started for the jail, where he will be obliged to stay until 4 o'clock this afternoon. Shortly before noon Driggs and his lawyer, Hugo Hirsch, entered the court- room. United States District-Attorney Youngs and his assistant, Mr. Chat- field, who conducted the prosecution, were already there, and as soon as Driggs was seated Judge Thomas took his place on the berch. Without any preliminaries Driggs was ordered to rise and advance to tho bar, Judge ‘Thomas then said: Judge to Prisoner, “1 would that a sense of propriety bad made this offense impossible even with- out the constraint of the statute, whose wholesomencss and deterrent spirit are clear, notwithstanding some imperfec- tions of phraseology. “The provisions of the statute deprive you of the capacity to hold office under the National Govermnent. Tho signifi- cance of the disfranchisement will not be apprehended by persons of inferior sensibility, but its magnitude and the fine that will be imposed exclude fitness of a larger imprisonment than that exacted by the law. A just fine will leave you no benefit of the under- taking.
