Injunction Reetraining the Com- mittee from Bidding on Prop- erty Denied, THE S1 OckHOLOERS RECOURSE. | If They Are Not Satisfied Their Only Redress Lies in the Courts. Judge O'Brien, im Supreme Court Chambers to-day, denied the applieat for an injunction to restrain the Reor- gunization Committee of the Whiskey Trust from bidding on the cighteen dis- tiliertes which will be offered for sale by the recelyer of the ‘Trust to-morrow. Under the scheme proposed by Reorganization Committee, the ne company ts to he capttaliaed at $35,000,000 | and the old Trust stockholders are to re- ceive share for share in the stock of the new concern. The application for an injunction was made by Bamuel Untermyer on behalt of Frederick Onnes and George M Pynchon, the alleged owners of 15 shares of the old Company's stock. They alleged that the result of the scheme of the Reorganization Commit- tee If carried out would be to perpetu- ate the old monopoly of the Whiskey Trust in a new guise, and that the Com- mitteo would be foisting on the specu- + lating public $35,000,000 worth of stock on property purchased for not over $10,- 00,000, and that the entire scheme was a gigantic stock-Jobbing operation, The decision of Judge O'Brien, which is in favor of the Reorganization Com- mittee, makes it clear that those stock- holders who do not approve of the Committee's scheme have recourse in law for any injuries they may sustain.
