Meade's Charges Ai Qu'rageous and Fa Testimony All In and Mr. Choate Begins His Summing Up. The third day of Medical Inspector Edwar§ Kershner's court-martial on the charge of perjury and violation of naval rules began ai 10.30 this morning in the Brooklyn Navy-Yard, Joseph H. Choate, sentor counsel for the accused, had not arrived at that hour, and the trial went on without him. Dr. Kershner was again accompanied in court by his son, Lawyer Hinsdale, for the defense, then read a report sent to the Secretary of the Navy for Capt. Phillip, former com- fying on his honor that he believed Dr, Kershner to ve a capable, trustworthy and accomplisned officer. There was another momentary break; then Mr. Choate and Surgeon-General Tryon ar- rived, and tne work of the day began in earnest. Dr. Kershner was called on the stand, He sali he had not expected such a charge as Admiral Meade had made jainst hom “It Was an outrageous, unjust. and mainly false charge,” said he. “It re- flected on my private and professional and T felt that nothing in the charge was correct.” Kershner especially ubjected to Meade's. calling im “timid,” not “up to date” and a hronic fault-finder." Dr, Kershner wont on to defend his action In sending coples of the report of the Court of Inquiry to the Surgeon- General, by saying it was customary and that he had not known article 235 of the Navy Regulations, which forbids Such an act, was as binding aa it is, He positively “denied having given out voples of the report to the newspapers. . Kershner said that during the in quiry on board the New York he had started to tell the court that he had sent a copy of the report in question to a friend In the United States. He had been interrupted, however, and told that the inquiry ‘was held’ merely to ascertain who had sent verbatim copies of the report to the newspapers, and that he must confine his remarks to that subject alone.’ With this idea in view he had made what to be true answers to the court's ques tlons. He dented to-day that he had sent yerbatim coples of the report to the Surgeon-General or to. Bloodgood. Nothing had been asked him at. the Court “of Inquiry, he claimed, “substantial copies. ‘The newspaper article, Kershner said, could not pos- sibly have been taken from the copies he sent Bloodgood Capt, B. R. Russell, of the Marine Corps, was the first witness called In the afternoon, Russell testified he had been & membe? of the Court of inquiry which Kershner was witness on April 6, He said that no stenographer had been Frerent at the inquiry, and he ald not think the recorder, whose business it was to dowti the evidence, had taken sentence of it. He thought the word ‘verbatim’ had’ been used in the examination by Huse. Dr, CA. Pardee, of 6 East Forty-third strest, New York, Dean of the Medical Faculty of the University, sald he had Ynown Dr. Kershner hitimately for tnirty-five years, Kershner, he safd, has always been spoken of in’ the highest terma as a man of high personal char- acter and aollity.
