ALBANY, April 2.—The Assembly to- day passed, by a vote of $9 to 10, the Percy-Gray bill, legalizing racing in this State and permitting betting under cer- tain narrow restrictions, There was very ilttle opposition to the bill, the only discussion coming from the cham- pions of the small Winter and disrepu- table half-mile tracks. ‘These made a fight to have the bill amended so as to extend its privileges to the very Institutions which the bill Giscountenances. The bill will be sent to the Senate at once, and may be called up on Friday, The friends of the measure believe that it will get through the Benate some time next week with- out serious opposition. The Assemblymen who voted against the bill were: Barry, Brush, Cain, Mad- @en, Nixon, Read, Sanger, Scanlon, Harry Schulz and J, N. Stewart. When the bill was called up in its regular order on the calendar, Assem- blyman Madden, of Queens County, went to the desk with two amendment: One of them extended the privileges of the bill to all race tracks without dis- tinction, The other granted the right of appeal to petsons who ure refused licenses by the State Board of Raving, and provided that such appeal might be taken to the Supreme Court. He sald the owners and patrons of the emailer tracks are entitled to as much consideration and fair treatment as those of the big track. ‘The amendments were vigorously op- posed by Chairman Robbins, of the Codes Committee, who said that the main purpose of the bill was to free legitimate sport from the taint and evils that the operation of small and irresponsible tace courses placed upon the legitimate sport of the turf. It was this consideration, based upon the as- surances of men who had millions in- vested in horses, and who followed the sport for unselfish reasons, that had in- splred the Codes Committee to report the bill favorably. He favored the pas- g@ige of the bill because he believed it would restore racing to its former repu- table condition. He also favored, as a supplementary measure to the Percy-Gray bill, the passage of Mr. Wilds’s bill prohibiting betting of any kind at any place, with- out distinction, in this State. The Wilds bill will come up to-morrow. The Madden amendments were also opposed by Assemblymen Hennessy, Blake, Malby and Foley. Assemblyman Finn supported the amendments, but they were lost by a vote of 76 to 24.
