District-Attorney Fellows stated very positively this morning, before the con- vening of the Court of Oyer and Ter- miner, that none of the cases of accused police officers which had been placed upon the calendar would be tried to- day. These included the cases of Capt. Max Schmittberger and Ward Man Jeremiah @ Levy and Samuel Campbell, indicted for bribery and extortion, which were the first three in order on the calendar. Then followed Detective-Sergt. Frink, Sergt. O'Toole, ex-Capt. Doherty. ex- Sergts. Hugh Clarke, George C. Liebers, James W. Jordan, Charles A. Fellows to an “Evening World” reporter this mornipg, ‘and in all probability 1one of them will be called until next week at the very earliest. Why are they to be postponed?” “Because we require more time in which to prepare them for trial.” Several of the counsel for the accused Police officers, including William F. Howe, Abraham Levy, Joseph Moss and ex-Surrogate Daniel Rollins, came into the court-room at, 10.80. Lawyer Howe said that he had his plea for Capt. Schmittberger with him, and he . Was prepared to present it to Judge In- ¥ranam if any attempt was made to fol the Captain to trial. “I have heurd that Col, Fellows is not Teady to call the case,” he said, “and 1 take that as an indication that the in- fluence of Senator Lexow and his Com- mittee has prevalled. Lawyer Levy, who is counsel for Ward rem! 8. Levy, wal do not see how Col. Fellows can be unprepared to go on with this Levy case, for it has. been tried once before, and he "has had plenty of time since then to pre- pare tor it.” ‘There was a good deal of grumbling on the part of the other lawyers, too, when it was learned that the District- ti Attorney would not proceed with the lice trials. hmittberger mpbell, there were 2; for to-day those of Roundsman Downes and Officers Kearin J. Larkins ‘and John Kenny, who have been in: dicted for collecting blackmail from east side street peddlers, When Judge Ingraham finally took his seat upon the bench it was nearly 11 v'clock, and the court-room was crowd- ed. The District-Attorney’s office was represented by Col. Fellows, Mr. Mc- Intyre and Mr. Lindsay. Col, Jonn R. Bchmittberger, said this afternoon that he asked Col. Fellows this morning what was to be done In the case, as he was ready to present a plea that his client Was under the protection of the Sena: Col. Fellows said the case had been postponed indefinitely. “Then,” said Mr. Howe, “I may take my client out of court “You may.” was the answer, Lawyer Howe is positive Schmittber- ger will never be put up for trial again. ————9 ————— STEPHENSON GETS A DELAY. The = Sing Remo Postponed for a Few Days. Ex-Police Capt, John T. Stephenson this morning gained a few days’ stay ef sentence of three years and ten months for extorting blackmail. Jus- tice Gaynor, in the Supreme Court, Brooklyn, granted the stay. Lawyer John Vincent asked that ar- gument be postponed untll Saturday at 2 o'clock. Mr. Vincent said District- Attorney Fellows, of New York, was not Teady to go on to-day, and at Mr. Fel- lows's request Stephenson's attorneys, Messrs, Jenks and Vincent, had consent- €d to & postponement. Judge Gaynor granted the request. HARCOURT HOLOS ON. Denial of s Rumor that the Lib- eral Leader Had Resigned The Pall Mall Gazette Responsible for the Story. Mappenings of the Day on the Other Side of the Atlantic. LONDON, Jan. %.—The Westminat Gazette authoritatively denies The Pall Mall Gazette's report that Sir William Harcourt har resigned and that a dis- solution uf Parliament is imminent, and @ays that no question has arisen which could lend the slightest color to the rumor. It is bellevea that The Pall Mall Ga- zotte'n report was based on the fact that the Postmaster-General, Mr. Arnold Morley and = the_~—~Preal- dent of the Local Government Board, Mr, Shaw Lefevre, both of whom re Cabinet Ministers, have been sum- moned from Monte Carlo, where they had just arrived, in order to attend a Cabinet Council, which Is to be held here on Thursday next. The Press Association is informed officially that there is no foundation whatever for the report that Sir Will- jam Harcourt has resigned or that @ dissolution of Parliament ts imminent. The Cabinet Council which haa been called for Thursday has no reference to any such contingency, nor has Lord Rosebery's visit to the Queen this after- noon any bearing on the subject. It ts the intention of the Government to pro- ceed steadily with legislative work dur- ing the coming session.
