Laws, accused of robbing an injured man at the Central Emergency Hospital, was given a hear- |ing yesterday in Judge Cook’s court on | a petition for a writ of habeas corpus, | but the arguments were continued untii | Thutrsday, when the case will be con- 'cluded and the court’s decision given. ‘ The alleged robbery occurred several months ago. William Bolte shot and | serfously injured Don Ritchie, alias |John Lovejoy, in a fight at the Terminal Hotel. Laws, arrested Bolte and took Ritchie in an ambulance to the Central | Bmergency Hospital, where it was found |that the wounded man had $620 in his pocket-book. When the hospital officials prepared to put the money in the safe a few minutes later it was | aiscovered that $120 was missipg and Hhe money was found in Laws' posses- | sion. Laws was suspended from the police force during an investigation of the matter and given a preliminary hear- |ing in the Police Court, at which | Ritchie testified that he had glven the money to Laws. The case was carried to. the Superior Court because of a suspicion that collusion existed be- tween Laws and Ritchie, but in the face of the latter's statement that he voluntarily gave the money to Laws it is probable that the writ of habeas corpus will be issued and the prose- cution dropped. The case was that of A. A Headrick and Charles M. Baillie against Peter Larson and Thomas L. Greenough. Headrick and Baillie are owners of the Black Hawk lodes and the Alvy lode in Idaho. They alleged that Larson and Greenough had constructed a tunnel penetrating the Black Hawk on its way to other claims owned by the appellants; that the tunnel ran into a ledge apexing in the Alvy claim, tne right of way to which Larson and Greenough had obtained by condemnation. The appel- lants asked that they be permitted-to use the tunnel jointly with the build- ers. Larson and Greenough, the builders of the tunnel, won the case in the United States Circuit Court of Ildaho and Headrick and Baillie took an ap- peal. The appeal court yesterday de- cided in favor of the tunmel builders and afirmed the decision of the Idaho court. Judge Gilbert, in rendering the decision of the Court of Appeals, said: If the appellants were seeking to condemn a right of way to widen the tunmel of the appellees, and showing a necessity therefor for the purpose of laying their own tracks in the widened portion thereof for working their mines and extracting ores from their subterranean ledges, the doctrine of Clark vs. Nash would be pertinent. But the purpose of the bill is | to obtain the right to use a tunnel which has | been made by the appellees at thelr own ex- pense for thelr own purposes with tracks and facllities, it may be assumed, no more than sufficient for their own use. Knowland: “Have taken up with the War De- partment the matter of repairs on the transport Sheridan and have been given assurance that Mare Island will be given the work.” This is good news for the navy yard, The cost of the work will be more than $400,000.
