McDonald. OAKLAND, June 14—The taking of evidence in the trial of Al C. McDonald, charged with having shot and killed Joseph Mello of Pleasanton. was begun this morning. The witnesses examined 89 far are Perry A. Havelin, deputy | County Assessor, who produced a ground plan of the house at Pleasanton where the shooting occurred; Drs. Sam- uel J. Wells and C. A. Case, who were | called to attend the dead man: and Bert Carnes, a bartendér, who was one of the first to go to the house after | the shooting took place. Mello, Carnes testified, had a slight rattle in his throat, but died within a few minutes after hig arrival. Carnes was accom- panied by Frank Nevis. The only point over which there was any coptention was in regard to the clothing of the degceased. MeDonald | has stated that the reason he shot Mello was on account of the fact that | he was attempting to take advantage of his wife and that his clothing was disarranged. Carnes testified positively | tipon this point, and stated that the | dead man’s clothing was as it should be. He, however, became considerably confused when on cross-examination he was shown his testimony given at the preliminary hearing, in which he stated that he haa not pald any attention to it. In the meantime it is probabdle that habeas corpus proceedings will be instituted by San Fillippo’s attorneys to secure his release from custody. It is rumored that another arrest may be made by the Sheriff tomorrow. The murderer Is belléved to have had an accomplice, who concealed the shell from which the fatal shot was fired. Father Collins is one of the besg-known Catholic clergymen in this part of the country. He was the first priest to be ordained at St. Ignatius Church. Father Collins, prior to his assoclation with St. Joseph's Chureh, in this city, was for many years a valued member of the Santa Clara College fac- ulty, and prior to that was connected with St. Ignatius Church in San Fran- eisco.
