CLAIMANT SUES QUEEN COMPANY \ Contending that the Queen City Fire Insurance Company is taking adva tage of a technicality to refuse pay- ment of $300 on a policy due him, Frank Kuffman brought suit in the Justice Court yesterday afternoon te recover that amount from the com- pany. Full proof of the loss is serted in the complaint, which is made after the Now York form. Alf Croves, who with Wiillam B. White represents the plaintiff, says that payment is refused on the greund that Kuffman changed his place of residence without securing necessary permission. The attorney also declares that the policy was left with the cem. pany’s agent some four or five days before the fire, for the purpese of hav- ing a notation made of the change. The complaint recites that Kuffman, sy on September 28, 1905, secured a policy running for a term of three years, cov- ering all household and pefsomal ef- fects in his residence at 455 Tehama ;!Neh For this he paid the sum of 4.50. x On December 6 Kuffman moved to 88 Harriet street, between Folsom. and Howard, the transfer being agreed to by the company. In March of the present year Kuffman moved for the third time to 6 Hayward street, and the complaint states that the transfer was again accepted by the company. After the fire, in which the loss ef property to Kuffman is estimated at $525, he made proof of loss, as required by law, but Payment was denied and suit is being brought for $299, $1 being rebated in ordeér that the case may be brought in a justice ceurt. “The company has refused payment,” said Mr. Groves, “on the ground that the last transfer from Harriet to Hay- ward street was not accepted. PARTLY BURNED POLE FALLS OVER WITH LINEMAN ON TOP Matthew Calvin Comes to Ground Sud- denly From High Perch and Is Seriously Injured. . Matthew Calvin, an electrician in the employ of the Mutual Electrical Company, whese home is in San Rafael, yesterday ascended a telegraph pole which had been partly burned during the big fire at Sixteenth and Mission streets while stringing feed wires. The pole did not show signs of having been sufficiently damaged to render it weak until Calvin got on the cresstree, when it snapped off a few feet from its base and fell with him to the ground. In striking the ground Calvin re- ceived serious injuries about the chest that may prove fatal.
