KANSAS CITY, May 22.—The gov- erfimént to€ay in the United States District Court here announced that it was rdady for trial on three of the cases. The cases called were of George L. Thomas, a freight okér of New York City, and his chief clerk, L. B. Taggart, under in- dictmeént for alleged conspiracy in se- curing rebates for shippers, and that aggjnst George H. Crosby, former as- sistant freight traffic manager of the Burlington Railway, charged with conepiraocy in giving rebates. Judge Smith McPherson of Iowa, sitting in place of Judge John F. Phil- lips, overruled the demurrer of the Burlington Railway to indictments against that company, and they must fiow go to trial. Bhe taking of testimony in the cases of Thomas, Taggart and Crosby, which have been combined for convenience, was delayed by the nonappearance of ho is ill in New York. A argument proceeded as to r the trial could continue in th absence of Taggart. NEW YORK, May 22.—Pleas of not guiity of the charge of allowing re- bates on shipments of sugar which had been made by the New York Central Radirotd, Nathan Guilford, its vice presiient, and Fred L. Pomeroy, its al traffic manager, were today wn in the United States dis- court. Eight demurrers were in- osed in their stead, chiefly on the ound that the indictments do not set forth the charges with sufficient particularity to enable the accused to mdke a proper defense. Southern Pacific announces two routes—sia STATE MAY NOT BE ABLE TO PAY INTEREST ON BONDS. Amount Due on Ferry and Seawall lgs sues Not Yet Collected From the Counties. SACRAMENTO. May 22.—It is possible the State may not be able to pay interest on the San Francisco seawall and building bonds and the funded debt when these obligations fall due July 1. The protraction of the legal holiday season has kept the various counties from pay- ing their pro rata of taxation, and it is possible that after the holidays have been declared at an end they will not come forward promptly enough to ene able the State to pay the interest on time.
