SAN BEI ARDINO, April 16.—Judge Bennett t morning brought to an un- expected termination the big water case of John H. Barton and others against the Riverside Water Company by grant- ing the defendant's motion for a non- suit. This action was brought to pre- vent the defendant corporations, four in number, from taking water from San Bernardino Basin and conveying it to Riverside and vicinity. The contention | of the plaintiff was that the water could not be taken from one basin for use in another to the Injuty of plaintiffs, who alleged that heretofore fertile and pro- ductive lands would be made barren by the lowering of the water plane by de- fendants. Judge Bennett denled every contention of the San Bernardino plain- tifts. The case is of far-reaching im- portance, as a verdict for the plaintiffs would have jeopardized a very large per- centage of the water rights of California. ——,—— TWELVE YEARS IN PRISON IS SENTENCE GIVEN A BRUTE cELD. BAKBRSFI April 16.—Henr: Sott, who was held over to the Su- perior Court from Famoso for assault- ing Jennie Jones. his 12-year-old step- daughter, was this morning sentenced to. twelve years in prison at San Quen- tin by Judge Mahon. Scott, who was arraigned before Judge Mahon last Sat- urday, pleaded guilty to the charge. In court today Segtt showed no signs of nervousness and throughout the entire proceedings was entirely composed. He will be taken to San Quentin tomorrow by Constable Ketis B SERERA
