GILLETTE OCCUPIES PECULIAR POSITION WASHINGTON, March 1—A peculiar situation has arisen in the army as to the case of Major Casslus Gillette, United States engineer, who is now superintend- ent of the Philadelphia filtration plant. According to the press dispatches, Major Gillette, who has for some months past been acting in the capacity of an expert assisting in straightening out the affairs of the filtration office, yesterday accepted office as superintendent of the filtration bureau. Up to that moment there was no ques- tion about his status, as he was simply an army officer .employed by the city of Philadelphia under detail from the War Department. But when he accepted office yesterday and took the oath as a civil officer he raised the point as to whether or not he had brought himself within the provisions of section 1222 of the Revised Statutes, which in substance cancels the commission of an army officer on the act- ive list who accepts a civil office. Today the officer’s resignation was re- celved at the War Department. The ques- tion whether an officer can resign an of- fice which he has ceased to hold or whether such a resignation can be ac- cepted 1s to be determined by the Presi- dent, for he alone is authorized to accept a resignation of this kind. Secretary Taft will take it up with him tomorrow. MARRIAGE TO END FIREMAN’S ROMANCE —_— PITTSBURG, Pa., March 1.—After fight- ing his way through fire and smoke to save the woman who will shortly become his wife, John H. Frazier, a member of No. 5 Engine Company in Chester avenue, left today for Pacific Grove, Cal, where he will be married to the girl he carried down a ladder wrapped in a blanket, a year ago. The story of Frazier's love is a romance. About a year ago a fire broke out in Kirk- patrick street, near Center avenue, and Frazier, who was a member of the Fire De- partment, was called upon to rescue Miss Mamie Kraupcops from the third story. He carried her down the ladder, and a week later the young lady, having fully recovered, asked for an introduction to the fireman who had saved her life. Miss Kraupcops is now visiting in Cali- fornia and Frazier, on leaving for the ‘West tonight, announced that he was go- ing to marry the girl he had saved. —_—e——————— REI'USES TO ATTEMPT STOP OF PROPOSED RAILWAY MERGER ALBANY, N. Hearst, demanding that the At- torney General begin proceedings to annul the charter of the Interborough- Metropolitan Holding Company under which the merger of the New York traction companies is intended to be effectuated. It was .practically settled today that Fish will lead a committee of policyholders of the Mutual in the United States and Europe. Invitations to prominent policy- holders in all parts of the United States were mailed today and many accept- ances are expected by those in charge of the movement. The proposed committee will work independently of the so-called “Gov- ernors’ and Lawson committee.” _Reports that Fish may be asked to accept the proxy of the committee In the évent of the overtlirow of the pres- ent regime are said to be without foun- dation. TR R SAILS FOR EUROPE. Former President McCurdy of the Mu- tual Life Takes His Departure. NEW YORK, March 1.—Richard A. Mc- Curdy, former president of the Mutual Life Insurance Company, sailed for Eu- rope today on the steamship Amerika of the Hamburg-American line, accompanied by Mrs. McCurdy and their son-in-law and daughter, Mr. and Mrs. Louis A. The- beau. Very different from that of most of the passengers on the big ship was théir departure. Instead of there being a host of friends to bid them good-by there was apparently none to see them, though about half an hour before “the vessel sailed one tall young man made a hurried exit from the door .of the luxuri- ous suite the McCurdys will occupy, and rushed ashore. Nor did any of the party appear at the rail with the other passen- gers when the ship backed out into the stream. Admission both to McCurdy’'s and his son-in-law’s rooms was denied to re- porters and two men who were said to be detectives stood at the rall leading to the suite until the time came for the steamship to sall. The McCurdys arose early and tea and toast was served in .their sitting-room about 8 o'clock. It was sald the break- fast had been ordered for the party at 10 o'clock. an hour after the Amerlka sailed. Several immense baskets of fruit and flowers were sent to the McCurdy suite before the vessel's departure. Those who saw McCurdy board the ship the evening before said he appeared to be in poor health. Thomas Beddow, Mc- Curdy’s coachman, who was locked up in the police station Wednesday night, charged with assaulting a reporter, did not sail. He was released after the ship sailed, the complainant declining to prosé- cute. Suits have been Instituted by the trus- tees of the Mutual Life Insurance Com- pany against former President Richard A. McCurdy, former General Manager Rob- ert H. McCurdy and the firm of Charles A. Raymond & Co., formerly general agents of the Mutual, according to an an- nouncement made by the Board of Trus- tees today. These suits were begun some time ago on the advice of Joseph H. Choate. Choate’s formal report was not made to the trustees until today, but the suits were begun on a preliminary ex- pression of his views made by Choate be- fore the completion of his formal opinion. The trustees at their meeting today ac- cepted the resignations of Effingham B. Morris of Philadelphia and Stuyvesant Fish. ANOTHER BANK FAILS TO OPEN ITS DOORS FORT SMITH, Ark., March 1.—The Southern Bank and Trust Company, & recent corporation, with an authorized capital of $600,000, failed to open its doors this morning. A notice was post- ed to the effect that the bank’s inter- ests had been sold to Thomas Neal, an attorney of Fort Smith, who, it was stated, would pay all depositors in full. The deposits amount to about $80,000. The assets are about a like sum, 2 The Southern Bank and Trust Com- pany was a branch of the Southern Bank and Trust Company of Dallas, Tex., and was organized less than a year ago by its president, C. C. Walter of Dallas, Tex. Some time ago there were rumors on the street that an authorized capital of $600,000 had been paid in. It is understood that Walter gave bank stock for real estate, which was placed in his own name. As a re- sult of these rumors small depositors began withdrawing their money. Sankey's evangelical ‘work, a picture of the Golden Gate, en- titled ““The Garden of the Gods,™ pre- sented to him by friends in San Fran- cisco after he and Mr. Moody had held a revival in that city, was cut from its frame by burglars that entered Mr. Sankey’'s home in South Oxford street, Brooklyn, early Monday morning. So crudely was the work done that in all probability the plcture is destroyed, for the burglars, instead of cutting next to thé frame, cut along the edge of the stretcher, leaving a margin of nearly three inches. Two other oil paintings were destroyed the same way and the burglars stole enough silverware and bric-a-brac to make the total loss not far from $1000. It was at Mr. Sankey’s request that the police did not make the news of the burglary public, as he feared that it would cause his many friends to worry. Hopelessly blind and bedridden, he was greatly relieved when told that the rob- bers had not injured any one of the household. Mr. Sankey is attended by a graduate nurse, who did not retire until 3 o'clock on Monday morning, so that it was after that hour that the burglars entered the house. No one was disturbed by them and the first intimation of the theft was when servants went down stairs at 6 o’clock and found the pictures cut and deeds and valuable papers, which had been taken from tin boxes, strewn about.
