The Superyisors’ fire committee yes- terday deferred for ‘one week thé pro- | posed amended building ordinance de- signed. to compel the-construction -of “Gavernment, [N LAND OFFICE Blefi Gold Fields of Nevada *‘Scene- of Alleged Swindles in - the: Location Claims INVESTIGATION ~ BEGUN Fed.eralf Mineral Surveyors Aceused of Using Office to : Manipulate Properties ‘A-new.swindle-in public lands, and one thdt promises to: be of ‘gigantic propor- is, is on-tHe point of being unearthed by the Land Office of the United. States The -scene-of the frauds is in thé new gold fields ot Nevada. It is alleged ‘that United States Deputy Min- eral Surveyors have been locating claims and -dealing -widely in mining propérties, contrary to law. : Bection 452 ‘of the Revised Statutes of the, United -States says: *“All officers, clerks, ¢mployes in the office of the: Sur- veyor General, of local offices, and the ‘General -Land Office, -.or ' any persons wherever located, employed under the su- pérvision of the Commissioner of the Lind Office, are .during such employment pro- hibitéd from -entering or becoming inter- ested; "directly-or indirectly, in any public 1dnds ‘of. the. United States. In addition, the Supreme Court of the United States: has ‘held: that all public lands ‘located: by deputy - United States minergl surveyors shall-be held for can- cellation, and that such: locations are in- valid. In the face of this prohibition it is ¢laimed that Deputy ~Surveéyors in and _about -the Nevada . gold fields have . been . locating - claims _either in . their’ ‘own. names . or through confederates . and Selling = them. - ‘One survéyor. in - Hawthorne 'is sald to have made $300,000 in ‘the last two years by this- method. In all probability the titles -obtained from- these men are veid, the- original Joeation 'being . invalid, and nany - iinocent ‘purchasers will be. able to save -their holdings only by immediate- 1y . reslocating. - At theé present -time: it is ‘nbt known how wide the area of these alieged frauds is; but it is-already sur- nised -that they may extend not only through Nevada, but also to Utah, Arl- zona: and California. The method ‘of the manipulators is in- genjous ity its simplicity. By the laws of thé . United States, -any :citizen, or alien having made- a declaration of intention to ‘héconte & -citizém, :can lacate a ‘mining clairn. upon- United. States public lands, such c¢laim tobe not mere than 1500 feet in length and 600 in width. A person lo- cating -usually: does ~so ‘by erecting monysients - marking ‘the appreximate boundaries. A United States deputy min- eral stirveyor thén Toeasur¢s it accu- fately. “As the prospector: usually over- £stimateés_ in-his rough measurements, there is nearly ‘always a fraction left ‘over. -t is these fractions that it is claimed: United States Mineral Survey- ors have beéen locating on their own ac- egunt, and, in ‘'some -cases, adjoining land; . Usually this is ‘done by some confederate, buit:is said that some of the mien have In many cases been bold cnough to do it in their own name. As the opinion of a United States Mineral Surveyor.-upon -the value of mining properties stands high with the invest- -ing public, it is then easy for them to ispose. of their claims at good priees. - “Complaints from buyers who have found their titlés worthless ‘from the fact that such focations are invalid have Been made - of late to the Department of the Interior, and an investigation is taking place. * GEARY STREET CASE AGAIN ON ARGUMENT Judge Murasky Will Pass on Municipal Owner- ship Suit. For a second time since the suit, was instituted, argument is being made on the petition of Isaac Strassburger for a writ of injunction to prevent the city fronmi acquiring. the Geary-street rail- road. - The aetion was first assigned to M. Before Judge Sloss had an opportunity to sufficiently investigate the issue, he was made a Justice' of -~ the Supreme Court. The matter was -then' assigned to Judge Frank J. ASSERT SMOKE 1S A NUISANCE Protestants Complain of Bad Odors Coming From the Sanitary Reduction Works ORDINANCE WITHDRAWN Drug Clerks Abandon Plan to “Restriet Sale of Carbolie Acid and Other Poisons The = Supervisors’ health committee yesterday considered. the protest of Samuet Samter and M. MecCurrie against the alleged nuisance caused by the smoke from the chimney of the Sanitary Reduction Works. The pro- testants complain that the odors dur- ing southerly winds extend over a large area of the eity and permeate the air’ with nauseous and obnoxious gases. C. L. Tilden, president of the corpora- tion, stated that efforts had been made to aveid any huisance and that a de- vice had been installed by means of which water is played on the smoke as it risées from the burning garbage. If any suggestions are offered to improve the conditions they will be tried by the company. The committee postponed ac- tion on the complaint and an effort will be made to secure the attendance of former Works Commissioner Manson, who on February 19, 1902, urged the corporation “to apply effective meas- ures to prevent this long continued nui- sance.” The committee also considered the petition of the Drug Clerks' Assocla- tion that ordinances be passed to re- strict the sale of carbolic acid, creosote, 1ysol, ecocaine, opium, merphine and other peisons and narcotic drugs to the general public. Several drug dealers opposed the passage of the ordinances because the State laws already cover the points involved. Objection was raised by Professor Searby to the provision of | the “ordinance requiring carbolic acid, lysol ‘and creosote to be diluted with 10 per cent of alcohol on the ground that the poisong could not be utilized for certain purpeses and the public who would want to use them as a preventive of disease would be inconvenienced. The ordinances were then withdrawn by the Drug Clerks' Association because the em- ploying druggists are opposed to them, it being deemed not wise to antagonize the employer: ——————————— Boren Goes to Prison. William H. Boren, who was convicted in the United States District Court in ‘April, 1905, of subornation of perjury, ‘was taken over to the State peniten- tiary at San Quentin yesterday by United States Marshal Shine. Boren was mixed up in timber land grabbing frauds in Shasta and Trinity counties. Since his conviction he had been confined in the Alameda County Jail, pending appeal. He must serve his sentence of two years' imprison- ment at hard laber in addition to the time heé has already served. ,,, oLD FAMILY ‘"'P-va . 3 .
