Kohn Are Untrue. George A. Kohn, against whom Thomas B. Coghill, his former partner in the wholesale grocery and commis- sion business, made sensational charges of fraud and embezzlement, was vindi- cated in a decision handed down by Su- perior Judge Seawell in the action in- stituted by Coghill against Kohn for an accounting and dissolution of part- nership. Not only does the court acquit Kohn of all charges made against him, but he exonerates him from any con- nection with the misdeeds of H. M. Fortescue, the firm's bookkeeper, who embezzled more than $30,000 of the firm’s assets during the many years of his service. On February 10, 1888, Coghill and Kohn entered into partnership. For many years their business prospered, but late last year a complete examina- tion of the books was made and it was found that between $30,000 and $40,000 of the firm's assets has disappeared. The discovery was followed by the de- parture of Fortescue and a further in- vestigation disclosed the fact that some of the books and many vouchers had been destroyed. Then Coghill reached the conclusion that Kohn had been in league with Fortescue and had caused | the bookkeeper to falsify the accounts, with the result that thousands were lost to the plaintiff. In conclusion Cog- hill prayed that the partnership be dis- solved and that he be given judgment for all the remaining assets of the firm, valued at $59,386 67. While granting the decree of dissolu- tion, Judge Seawell held yesterday that Kohn, not being guilty of any of the charges laid against him, was entitled to an equal divislon of the assets of the firm. Under this decision Frank Grimes, custodian of the firm's funds, will now equally divide the same be- tween the alienated members of the disrupted firm. —_——— HANDWRITING EXPERT GIVES TESTIMONY IN FAVOR OF MANN Says Disputed Indorsement on Ward Letter Does Not Look Like De- fendant’s Penmanship. NEW YORK, Feb. §.—Edwin B. Hay, a hapdwriting expert, was the first witnees to- day in the trial of Colonel W. D. Mann, editor of Town Topics, on a charge of perjury. After examining a number of canceled checks Dbearing the admitted signature of Colonel Maun, Hay sald there was no resem- blance between those writings and the d puted indorsement upon the Count Ward let- ter, because the letter indorscment was & monstrosity, written hurriedly, and the check Indoreements were written most carefully. Hay's. testimony on cross-examination was mors favorable to Colonel Mann than was his drect evidence yesterday. To-day he said the “K'* of the “O. REDWOOD CITY, Feb. 8.—Albert Eikeren- Kotter, the indicted superintendent of the County Poor Farm, came here this morning and surrendered himself to Under Sheriff Butts. Needham, an alleged coun- terfeiter, arrested in the metropoiis. They came here to search his room at the residence of E. W. Douglass, who conducted a chophouse here with Strong as his partner. A counterfeit- ing outfit was found in his room at the Douglass place, together with skeleton keys, masks and other burglars’ para- phernalia. The detectives believe they have captured an all-round crook, who has operated extensively up and down the coast.
