Upon this show- ing the prosecution rested in rebuttal. | The surprise of the day was sprung | when . the defense announced that it was willing to submit the case without argu ment. This occurred after some wrang- | ling between the two sides as to how | many of counsel should argue the case. The prosecution was taken entirely by surprise, and Deputy District ‘Attorne: Greaney repaired to the office of District | Attorney Byington for instructions. He rcturned in a few minutes and stated that the prosecution was also willing to sub- mit the case without argument. Judge | Cook stated that he was taken by sur- prise, and adjourned the court for half an hour to prepare instructions and to study the instructions submitted by coun- sel. Upon the return of Judge Cook both sides walved written instructions, and an oral charge to the jury followed.
