Richardson, a farmer, residing necr Byron, testified that he was driving along the road on the night of the. dis- aster. He said he saw the Owl and heard the fiyer approaching. He swore that he saw a moving light not more than 150 feet in rear of the Owl. He said it was a white laptern and was moving in a circle. Richardson said he did not think the man | was running. There was some expert testimony about | the impossibility of stopping a sixty-mile an hour train in less than half a mile and an adjournment was taken until next Wednesday. OROVILLE, Jan. 2—What would have proved an absolutely sure cure for snor- ing if a little more energy had been used was that administered by John Jost, aged 76 years, upon John Justice, §2 years old, at the Butte County Infirmary at an early hour this morning. Jost used a hatchet upon the aged snorer, ‘and although the wounded man still lives his recovery Is | not yet assured. Jost and Justice have been inmates of the infirmary for about three years, They were formerly neighbors, and since en- tering the institution have occupled the same sleeping apartment.” Justice had acquired a habit of snoring, which be- came very annoying to his erstwhile friend, who often during the night found it necessary to awaken his aged room- mate in order to obtain a chance of sleep- ing himself. Last night he became annoyed to the point of exasperal unsuccessful,attenipts to rouse Justice by calling, e procured a hatchet which was in the room and made an assault upon the sleeping man. MONTANA SUPREME COURT CITES A SUPERIOR JUDGE Must Show Cause Why He Refuses a Continuance to Attorney Ac- cused of Bribery, BUTTE, Mont., Jan. 2.—Disbarment pro- ceedings against A. J. Shores, chief coun- sel for the Amalgamated Copper Mining Company, were brought to trial to-day before District Judge McClernan. The proceedings were instituted by District Judge E. W. Harney, who alleges that Shores offered him a bribe to reverse a decision in the now famous Minnie Healey case.
