The hearing of the petition of Theresa A. Oelrichs, Viriginia Vanderbilt and | Charles L. Fair for distribution to them of the personal property of the estate of the late James G. Fair has been turn- ed into a scramble for attorneys’ fees, ‘with the attorneys representing the trus- tes and executors leading the scramble. Ex-Governor Budd, Knight & Heggerty and Charles S. Wheeler have been exam- ining Charles S. Neal, manager of ths estate, for several days to try and estab- lish the great value of the personal prop- erty which there is to distribute and to establish a basis for the construction of the trust clause of the will so that it will fall, let loose the personal property into the hands of the Fair heirs and bring big fees to them. Attorney McEnerney and ex-Judge Hayne, on the other hand, simply want to prove that the work of the executors and their lawyers was well done. They want to sustain the validity of the trust clause if possible. The attorneys for the executors have already _received $185,000 for their ser- vices. ~ Under Judge Coffey’s schedule the attorneys’ fees on a $17,000,000 estate, which it is claimed the Fair estate is, would amount to $53,000. The attorneys have already received about four times this amount. | On the other hand, the attorneys repre- senting the Fair heirs have not as yet been paid. Their fees are all contingent, so yesterday ex-Governor Budd protested and Wheeler protested against the effort of opposing counsel to produce testimony upon which to base their demand for counsel fees, while Hayne and McEnerney fought for the coveted right. Finally Judge Troutt ruled that in the hearing at bar it was not proper to establish a basis for a demand in the future for atterneys’ | fees, but he initmated that in event he | ordered the distribution of the personal property to the heirs he would order $100,- 000 withheld for which the attorneys for the trustees could battle later. f During the morning session Manager | Neal talked about millions. His testi- mony established the following facts rela- tive to the present financlal condition of the estate: Total income from real estate since death, $1,379,077 53; income sales, real estate, $150,000; income from Pine and Sansome, $268,511 83; in- come, Mission-street property, $40.862 12; in- come' from personal property, $1,887, Come from Sales of personal property. $4.164.- | 641 8.
