W. Tomlinson, of the sloop Amigo against the sloop Presto for one alleged foul in ths annual regatta resailed ol Sunday. Mr. Tomlinson testified that after cros: ing the startng line and while on the starboard tack he observed the Presto on the port tack in such dangerous proximity that he hailed her and expected that her helmsman would put her about. This was | not done, however, and, to aveld a colli- | sion, the Amigo was luffed, and in order to weather the stakeboat nearest the wharf was compelled to come about on the port tack. then the Amigo nar- rowly missed entangling her bowsprit in the to&nlg;—llfl of the Presto. Frank Stone, owner and sailing master of the sloop Presto, testified that he had to pay off to get round the stern of the sloop "Aeclus; then he sighted the Amigo and came about to give her the right of way. He also said that at no time was the’l’resto less than thirty feet from the Amigo. After hearing the testimony. the re- gatta committee, consisti of R. R. T'Hommedieu (chairman). T. F. Tracy and Harry Gibbs, unanimously decided not to allow the protest. The Macdonough cup, which is the first prize in the thirty-foot class, accordingly goes to Frank Stone's Presto, and the prize for second place to Westerfeld and Morrow’s Aeolus. The awards in all the other classes, as already given. were confirmed. A special cup was awarded to Gutte's schooner Chispa. the only boat in the seventy-foot class to g0 over the course on Tuesday. e Cruelty to a Horse.
