NOW A QUESTION OF JURISDICTION o TR ROBINSON SUIT BEFORE THE COMMISSION. Unconfirmed Rumor That Hunting- ton Has Left the City to Avoid Giving Testi- mony. The State Board of Rallroad Commis- sloners listened yesterday to arguments on the question of whether or not the board has jurisdiction in the suit recently instituted by J. R. Robinson against the Southern Pacific Company. Attorney Philbrook opened the argu- ment on behaif of the plaintiff. He de- voted half an hour to an attempt to convince the commission that he had been sneered at by opposing counsel for the purpose of poisoning the minds of the Commissioners against himself and the interests of his client. He appealed to the commission, and asked that the alleged acts.be given their true worth, Attorney Pillsbury, who appeared on by half of the rallroad company, disclaimed any attempt to discredit the standing of opposing counsel, and denied that he had been guilty of the acts charged. He also appealed to the Commissioners, and ob- tained from eaeh the assurance that they had not witnessed any discourteous acts. In reply to the argument of Philbrook, Pillsbury set up the claim that the Raii- road Commisioners have no jurisdiction in the present suit, for the reason that the statute provides that such suits must be brought by the Attorney-General at the request of the commission. He also claimed that if it ware lawful for persons to bring such suits in the manner in which the present ‘rfocsedlng has been inaugurated it would then be possible to keep Mr. Huntington in court for the bal- ance of his life at the will of every Tom, Dick and Harry who had or imagined he had a levance against the rallroad company.
